That's why the tree shouldn't be there to begin with. Until promoters get into the routine of making tracks safe FOR when shit happens, tracks will keep getting sued. This mentality has gone through every form of car and motorcycle road racing 30 years ago. The sport is dangerous enough as it is.

He made a tiny mistake, clipped a tree trying an outside the box, risky line that nobody else does.  
That’s what makes this guy great.  He’s a sender.

That’s it.  That’s all. No lawyers, no negligence, no conspiracy.  No need for change. No need to point fingers at anyone. I am willing to bet, had he glanced the tree, he would have moved further left a little away the next lap and still sent it. 

You guys are crazy trying to act as if the track / tree should be removed. The only constant variable in all of this is the tree.  It doesn’t move. 

 Chris Canning is still a stud, I am thankful he didn’t get hurt worse and will forever be a HUGE fan of his.
