It looks like the state is saying that he will be in their custody until the trial is over, not in the custody of ICE. That doesn't seem too unreasonable.
Based on the fact that he's been able to enter the country twice, I don't think deportation would be a great move.
ICE doesn't want to deport him.
They want federal control over a state system that everyone sees if fucked up beyond all recognition.

It’s not about deportation. While I’m not familiar with NY policy, the sanctuary laws in WA not only don’t obligate the local LE/Jail to notify ICE if the defendant is released-they forbid it. IOW, when/if some group of bail reform twats somehow bail this oxygen thief out, he could very likely be in the wind before ICE learns of his release. If they can get him in federal custody, they can avoid that possibility.
Sadly, for us real Americans, it's working out exactly how they want it to.
