The whole situation is fucked up. Baldwin was part or full owner of the production company and also the star (an employee of the production company. He hired a very inexperienced armorer that he bullied and pushed around. Apparently, they used live ammo on set for "plinking" so Alec could replicate in front of the camera. That's a big no-no.
His "legal" stand is that in his role as actor (employee)...it was the Armorer's job to ensure the gun wasn't loaded. He claims his EMPLOYER is culpable.
As employee AND employer he is "separated" in the eyes of the law. It's a shit show.
I think everyone believes he caused the whole thing but he's got a fairly sound loophole.
Doesn't matter who it is that pulled the trigger. Clint Eastwood or Mr Rogers.
The safety responsibility is ultimately on the holder of the weapon. PERIOD.
Any gun training/safety course beats this into your head.
...and he proves once again what a piece of shit excuse for a human being he is for trying shirk his ultimate responsibility.

He’s guilty of manslaughter, per the New Mexico statute, code, that I posted earlier. I’d convict him of Voluntary, but they’ll probably get him for Involuntary.

OK here is my view as an extra that has been on set in possession of a firearm and around others with possession. ALL of the movies I was on were cold sets so no ammo of any kind was involved.
The main difference was the movie budget. Low to no budget (indy films) there is no person in charge of the prop. The writer or director will say these are metal play guns that do not hold ammo, while off set do not display them.
Mid range budget there IS an armorer who issues you the prop, is there 100% of the time even in holding to watch over the prop. The bar scene I was in there were two detectives that had sidearms. Outside the bar the armorer said this is a cold set both principal actors have side arms and they will not be unholstering them. Inside the bar the armorer said again this is a cold set guns are present as side arms.
Ultra budget films you go to the prop truck, an armorer looks at your name and the scene and issues you a prop. They say this is a prop that does not hold ammo. You sign your name and are told to not lose sight of the prop while in your possession they take your voucher so that if you dont return it you dont get paid. Every time you leave set (say for lunch) the prop must be returned to the armorer. While in holding the armorer is 100% there watching that you are in charge of the prop.
Interesting note watching the trial: Live ammo had silver primer, cold ammo had a copper primer. Another ODD thing is Baldwins gun belt had the first 3 bullets were the silver primer or real bullets. I wonder if there was motive for someone in the crew to do someone in?

My thinking is close to TXDirt's. The actor was handed a prop by a supposedly trained / licensed armorer whose sole job is to look after the props and safety. The actors have their own job to deal with and I'm not sure if every actor given a prop gun even knows how to check it properly or the difference between live rounds and blanks. That's why the armorer is there.
And all of the mentioned real-world common sense gun safety practices ... I'm wondering if because of the presence of an armorer they are treated differently in the make-believe world of movies. Remember, on a movie set, there are times when you are supposed to look like you are shooting at other people.
BTW - Wasn't she the daughter of a famous armorer and she was just starting to break into the biz? I wonder if Baldwin felt pressured to give her a chance from possibly knowing her father? In any case, as it turned out, she clearly wasn't ready.
Couple questions for you as an actor: is there any reason for a live round to be on the set? I'm thinking they do not use live rounds to show bullet hits, etc. So where did the live round(s) come from?
Are there scenes where an actor is instructed to point a gun at another actor and even fire it? Or are you instructed to aim just off to the side of the target actor?
What's up buttercup? How about we listen to their own words. How about secondary inspection like they want for Boeing by yes The Actor! Or "common sense gun laws", movie sets should be gun free zones with zero tolerance, even prop guns. Let's apply their own words and standards and see how they like it.

There probably (and I'm not sure there isn't which Baldwin ignored) a rule about never any live ammo on the set.
Let's be honest here...a lot of shoot 'em up movies star or co-star "flavor of the day" celebrities that NO amount of training could make them learn how to "safe" a gun. That's why they are required to have ARMORERS. They hand the actor a safe gun and retrieve it immediately. Baldwin, the producer, fucked that all up..I believe on purpose.
If the prosecutor can untangle the mess about employee/employer and show Baldwin intentionally hired an in-experienced gal so he could bring live ammo on set...they might get him.
Didn't the judge rule they can't bring evidence or consider his position as the producer? Maybe I'm wrong, good drugs this week. 😁
Live rounds on set? None of the movies I was on had live rounds.
As for the scene and interaction with the director or AD. I cannot fathom the direction a primary actor gets for a scene. I was upgraded on set for a speaking role on an ultra budget film. I had an assistant and direction from the AD. But what someone like Baldwin gets is intense.

Do i think Baldwin will be convicted? All it takes is one juror to have reasonable doubt. I dont see him getting convicted.
Like I said...I haven't followed this case closely but I think I remember that Baldwin was hands on about location, crew, everything because he had skin in the game and wanted to cut as much "union" costs AND regulations as possible. Again his arrogance and dickheadedness. Jmo.
I might be mis-remembering but I think he's the one that wanted the live rounds on set. Was there bad intent...idk.

The fact that he’s been such a two faced piece of shit about paying the working Hollywood professionals is “par for course” for typical Hollywood ass holes like him.
The fact that he’s been such a huge anti-gun barking dog and…yet…can’t even handle a gun like a responsible adult, himself, is indicative of Hollywood idiots in general.
The fact that he’s outright lied about the shooting and his handling of the weapon is simply…well…he’s a POS. PERIOD. The gun has been tested…it hasn’t mis-fired and it’s proven to have correct “action”.

I'd like to hear more about the actual "instant of occurrence", and the lead up to it. Were they all together rehearsing the scene, going through the motions, confirming position and when that part of the scene came up the incident occurred?
Was it Baldwin being careless and reckless with the weapon while holding it using it as a pointer making point, making a joke? Why was the weapon being pointed and then discharged at the victim?
I heard he was practicing his quick draw.
That was soon after it happened, so who knows?
I also just read that the judge won't consider him being the producer as part of this case.
