I never indicated there was no assault. Only the folks betting the farm there was should take notice.

True I often struggle to understand what you're trying to say.

My apologies. It is one of my faults.

If the guard was attacked as a lot here like to think would charges not be filed? If the guard was not justified in UOF the same should apply. It can only be one or the other.

The speed of the suit being filed is worth noting.

I read that the same as you with the exception that the charge would be filed against the young man in the hospital and the deceased. Like WHAT?

Get what? That murder isn’t good.

That stating ‘you will probably die there’ is such immature posturing. As if physical strength and murder is what makes your strong. That the actions of the dead victim should be what is held to account and not the person who pulled the trigger.

All this John Wayne posturing and property valued more than human life is so just… sad really.  Like that’s the society you perpetuate and celebrate to participate in… just sad.

If someone came to my house to steal my bike and the only option I had was either lose the bike or murder them (legally with stand your ground or whatever). I would lose the bike.

But maybe I just don’t ’get it’. Murder may be within your morality, just not in mine. And to me the person that pulls the trigger is whole behave MUST be held to account.

It's a moral issue. My morality puts human life above property and ego, yours doesn't and based on the replies on this forum, it seems to be a distinctly American view that human life is secondary to property and ego. Which is honestly a bit sad really.

You start a fight with me on my land for your trespassing, I ain't fighting you. Too old for that shit.

Yes, I will probably shoot you.

I guess I take it for granted most folks understand that's not possible.

Please, by all means, clear this up, explain what you mean by this.

"If the guard was attacked as a lot here like to think would charges not be filed?"

What charges and against who?

Inquiring minds want to know.

How rural is the area you live in? Is your property fenced and gated? Lastly, if some little high school jerkoffs were sitting on the edge of your property smoking pot and you told them to leave. "Get the fuck off my lawn" and they turned around and said FU old man. Then what? My point is, there's a lot of grey in between someone saying sorry sir and jumping straight to fist to cuffs.

Maybe turn the water hose on them? I don't know, then you have to worry about shit randomly happening to your property. What's interesting is that sometimes we think of how we would want to handle a situation, but typically we only consider the extremes. There's a lot of middle. We are rural. property is fenced in and 3 dogs that go ballistic if you come near the fence line. If someone jumps the fence into that, we are past a lot of middle ground at my house and now into extreme territory.

Charges against the living gunshot victim that would justify the guards use of deadly force against him? I guess some folks just don't understand there is a certain standard that has to be met for every pull of the trigger. You can't just say I killed everybody in the room just because they where there and I feared for my life. If the guard was accosted by him why was he not charged?

Inquiring minds want to know...

You keep writing "charges" as in plural, many charges on one person or one charge against many persons. You could be more clear. Then you would not have to wonder why people misinterpret you. Whistling

So I guess it can only be one charge in your mind. Does it even matter how many? You wonder why your a vitard.

"The sheriff still has an investigation open and until it's closed it's entirely possible charges will be issued to one or both parties."

I don't wonder, it's a badge. What charge are you hoping for?

I am hoping for any that are justified.

My suspicion is that any charge or charges will never be filed unless there is a wrongful death lawsuit. The family has suffered enough. I once had my truck totaled by a guy that ran a red left turn arrow. Head on collision. His car totaled also. Cops never wrote him up for the illegal turn, said he had enough penalty just taking care of the damage. So I don't expect anything to become of this. At a minimum, unless it was plainly obvious the guard was not out of line, he'd be on administrative leave ASAP and charges (yes more than one) filed against him by now a month later.
