Everyone take note:
It doesn't matter if someone tells you a gun is NOT loaded when they hand it to you.

You MUST:
Confirm for yourself it is indeed not loaded.
Even if you confirm it is not loaded, treat it as loaded and never put your finger on the trigger unless you're ready to fire it and never, EVER, point it at someone you don't intend to shoot.

Alec Baldwin pulled the trigger. He was the last line of defense in the chain. He had the responsibility to personally verify that the gun was safe to operate for its intended purpose; meaning there were no live rounds in the gun. He did not fulfill this responsibility.

Yes, others are also culpable; the armorer especially, as the person with overall responsibility for every weapon used on set.

Ultimately though, it comes down to Baldwin having pulled the trigger. His actions directly led to the death of Halyna Hutchins.

Yah but,

there were protocols and procedures in place to prevent this from happening that involved others in positions of responsibility. It was not just someone randomly handing someone else a gun and saying it's not loaded.

Lots of reports that they were having gun issues before this happened.

Maybe I missed it but was he shooting a scene when this happened or was he playing around ? Just curious why the people who got shot wasn’t another actor in a scene that he was supposed to be firing a gun at. How’d it hit them and not another actor ?

Think about how often you see actors in movies firing weapons with the view from in front of them.
Perhaps that is what happened here

Why are the folks so intent on taking our guns away, so happy to profit off them? When is the last time you saw a movie without a gun?

My comment was aimed at the link you provided to claim that there were no union members of those 2 positions on site. The person quoted didn’t actually say that, but was very specific in saying that there were no union members from HER Local (Hollywood) there at the time, and she appears to be implying that the movie had members of other Locals working on it.

There may not have been any union members there at the time, but if that rumor is coming from what that person said then it’s a bad interpretation.

Yeah that makes sense, I wasn’t aware she was the photographer. Also want to add that I can’t stand Alec Baldwin but I don’t see how that’s even remotely his fault and it’s certainly not murder. He gets to live with that for the rest of his life because somebody handed him a gun with a live round in it. Sounds like they need to find a guy that loaded the gun to me

Depends on the the safety protocol. Sometimes the paid pretenders are required to dry fire before they point it. Him being a producer he may share some liability. Most of the blame will likely go to the prop master/armourer or the PM/line producer.

If he was just an actor his responsibility would be less, but he was a producer and star on set, so he had a bigger involvement in this than just an actor. Being that it seems there is a paper trail of trouble on the set in the days prior with potentially previously mis-fired weapons it seems there may be more to this story than a 1 time mistake.

As for an actors responsibility to make sure the weapon is safe before action is called, I don't work in film production but if I'm the armorer or Prop Master or whoevers job it is to make sure the gun is safe I wouldn't want actors jacking around with it after I've done my check.

As for the Politics of it. I think it's hypocritical to be a critic of 2A rights at the same time you make art glorifying gun culture, possession, and use.

Off topic but that reminds me of working LA auto show. Working 12-14hr days on Mercedes or GMC with a 30-45min lunch. Either find someone to shack with in Anaheim and drive an hour, spend out of pocket for a local hotel or drive 2.5-3hrs back to Chula Vista every night.

Not to downplay the issue, but those crews sound like they have it WAY easy than what Local 831 sd members were doing every LA show and with less break time.

Baldwin's worst worry will be a manslaughter charge. That's if there's enough evidence that he was grossly negligent in discharging the firearm. There's not a single person in law enforcement or the judiciary who would call this a murder.

Yesterday Reese95w posted that maybe it was a disgruntled employee who put real bullets in the gun and I posted that "that's just stupid!" Well they were real bullets and no ones sure how they got there but Reese95w theory is closer to being right than mine. No way I would have ever thought that they would even have real ammo on a movie set but for some reason they did, and now Reeses theory doesn't seem so stupid. Blush Blush

She’s the director of photography. She works with the electrics and grips to set up the shots.

So take this FWIW, but I had lunch with my brother earlier today who works in the film industry (in Atlanta). I asked him if he had any inside info, and he said that he didn't, but his GF (who also works in the industry) said she heard that the individual handling the guns that morning was not the armorer, but another crew member in props. She also confirmed that several disgruntled crew members walked off set that morning before the shooting.

I know there are a few people who work in the movies that post here, I wonder if there's any truth to that rumor?

According to Actors' Equity union:

- Treat all guns as if they are loaded and deadly.
- The property master or armorer should carefully train you in the safe use of any firearm you must handle. Be honest if you have no knowledge about guns. Do not overstate your qualifications.
- Never point a firearm at anyone including yourself. Always cheat the shot by aiming to the right or left of the target character. If asked to point and shoot directly at a living target, consult with the property master or armorer for the prescribed safety procedures.
- Check the firearm every time you take possession of it. Before each use, make sure the gun has been test-fired off stage and then ask to test fire it yourself. Watch the prop master check the cylinders and barrel to be sure no foreign object or dummy bullet has become lodged inside.
- If you are in a production where shots are to be fired and there is no qualified property master, go to the nearest phone and call Actors' Equity Association. A union representative will make sure proper procedures are followed.

Appears there were more than a few violations of the firearms use standard of care. Established system of controls, high-risk activity, disregard for basic safety..., Negligence is the word.

For starters, if he had learned about guns instead of bashing them, he’d know by the gun’s weight that it was loaded with live ammunition and not blanks. Most of the staunch anti-gun crowd have never even held one.

What charges were filed against Dick Cheney when he was bird hunting? At a minimum, Baldwin should get the same.

How much is the weight difference between a blank and a standard round? Serious question.
I have never held or fired a gun with blanks, but seems like it would be a pretty minimal difference to me.
Was the Gun on set a handgun or rifle?

Cheney wasn’t charged with anything, it was deemed an accident.

The two incidents are a quite a little bit different as Cheney knew that he had live ammo in his firearm, but also Cheney’s incident didn’t result in a fatality, either……

The political angles are fairly different as well as one of those was a political official at the time, the other a private citizen who is politically outspoken at times. They could be deemed similar politically is if one needs to view everything through the filter of whether they agree with someone’s politics or not.
