It seems clear that it was actually visa issues. Davalos is probably frustrated because he has been muzzled about the situation and he probably wants to tell his side but can't, lest he get his team/Bobby Hewitt in some trouble.

I suspect as you say its a terminology thing based on his fears if he leaves the US he won't get back. I know when I was going through the process I was told returning from Canada is actually harder than coming in on a flight from anywhere.
I would imagine the terms he has his visa under would be under scrutiny, i.e. if he isn't declaring he is there to race motocross as his profession, they may question why he needed to leave the country.
At the end of the day it sucked for him and I am sure he is the most upset about it out of all of us.
He wouldn't have been able to defend it.
He makes more in the 250 class than he would in the 450 class even if he won a championship.
Ask Bogle how that has worked out so far.

2. Besides 2014 -- and hypothetically 2016 -- when did Marty ever earn135 250SX Championship points in an nine-race season, 120 250SX Championship points in an eight-race season, or 105 250SX Championship points in a seven-race season?
3. How much is he making this year? How much could he make a 450 next year? How do you know that Marty would prefer a 250 ride over a 250 title?
Here is the section that would exclude him. Doesn't matter how many points he has previously scored.
2. A rider that wins a 250SX Championship will be eligible to participate in the 250SX class for a maximum of three years total regardless of what year he/she won the title. (i.e. if a rider wins the Championship in their third year of 250SX competition, they will be ineligible for the 250SX class regardless of points and therefore not eligible to defend their 250SX Championship title)
He isn't as fast as Bogle and will not make as much money as he does in the 250 class. He tanked the last two races last year for a reason.

It's like 10 years or more that he is running on the 250 indoor, nobody wants him for a 450 deal....so instead of telling the truth, he supposed that the people is so stupid that they will believe another stupid excuse from him.
He will never win anything, because he can't do it (real reason) and because he is such a cherrypicker that he wouldn't win even if he had a shot with the KTM junior cup.

The real reason Davalos didn't race Toronto was because he said he hated Maple Syrup and said the beaver wasn't a real animal..
I always fly outta Buffalo because it's cheaper. I have an easier time getting into the States then I do coming back to Canada. They grill me at Canada customs
