This story from JW, quotes the information that the late filing of a TUE has been accepted. It apparently comes from a 'reliable source'.???

Now we've had 6 months of zero, nothing coming out on this story from the JS camp. Now suddenly we have this quote from a 'reliable source' a week a way from a very important WADA/FIM hearing.

Seems a bit odd to me that the team would do such a good job of keeping silent on this, only to release a whole load of information with a week to go??? Are they that desperate to race the MEC that they think this will somehow get them on the line? Are they trying to get the fans on side prior to the hearing ('see look we said it was just a paperwork mistake'). Is this intended to try and influence that hearing?

What if the FIM?WADA hearing hands out a 2 year ban now? There'll be outrage from fans seeing as we've just heard it was 'just a TUE issue'. Anything more than a fine or a very short ban will not go down well following Weigand's story.

I'm just wondering whether the RacerX article is fact, or just another piece of PR aimed at influencing fans and decision makers?

Hopefully next week we'll have an offical FIM press release and it will all be over.

Which part of "STEWART DRUG TEST EXEMPTION APPROVED" you donn`t understand? You keep talking about positive test.
I don't get the bit that he's a year late, if he had got this for last year, it would not be an issue,

this guy gets paid more than damn near anyone in the sport, and has had the biggest entourage, i think he needs at least a fine, but think a couple of race suspension at least would have been good, maybe done a bit earlier so he could have missed the monster cup and some other nothing race and gone to A1,

It`s not long. I`d say it`s pretty fast. I didn`t think we`ll hear the verdict before New Years. Guy that I very well know went through this with WADA/FIM. He got notified about failed drug test in August and the verdict came out only in next April. That`s 9 month. Stewart got his answers in 5.
Its 6 months actually, and he doesn't have an answer yet.. Maybe after this hearing next week that was mentioned in the RacerX piece? The piece is a quote from a 'reliable source', its not fact.

Let's look at the possible reasons why this happened.

1. Complete stupidity by Stewart and his team.

2. Complete disregard for the rules by Stewart and his team.

3. Blatant attempt at cheating by Stewart and his team.

My point of my previous post was it doesn't matter why it happened, the punishment needs to be the same. In this case, it's pretty black and white that there should be at least a few races suspension.

Generally, a positive test like this in any sport gets you at least 1/4 of a season suspension. That's what Stewart should get. Banned for life? No. Suspended for at least a few races? Yes.

It's an absolute joke he's going to be able to race all 17 races. I don't care what rider it is, this is ridiculous that he will be able to race. It's special treatment to a top tier rider, only this time it is even worse than previous occurrences. If this is Jimmy Albertson or Cody Gilmore, do you think they'd be racing?
So, when a team gets caught using illegal fuel, the rules should be upheld no matter who the rider is who was using the illegal fuel.

We all know who had their bad gas test swept under the rug after throwing a bitch fit. This, after a number of other riders had their points taken away and not returned.

This sport has been known to do things for certain riders and certain people. The governing body is and has been a joke.

Had this been another lower level rider, no one would care because they aren't winning races. Thats the simple and plain of the whole deal.

Yes, rules are rules and they should be upheld, but until they do that for everyone, don't be surprised at how things play out.

its nothing to do with construction of a sentence, its more to do with the total disregard for the Stewart camp being in the wrong,

just because he has a release for next year, does not prove he was in the right this year,

That was bad when they did that, and I didn't think he should get his points back. The AMA got lucky on that one though with a halfway legitimate reason to fall back on being that the the illegal fuel was a rule put in for two strokes. It was still wrong to do and if any championship should have an asterisk next to it, that's definitely one you can point to.

They've done bad things previously but this one in my opinion is the worst if they let him race the entire season. I guess we will see how it plays out, but if the FIM/AMA does not suspend him for a few races at least, it's an absolute joke. This whole deal has been on ESPN's website. Just think about how bad this would look and the message it sends to the industry, general public, other sports, other riders, etc.

It's obvious that some people don't understand how the process works. At the WADA hearing, the WADA officials will decide whether to retroactively allow Stewarts' TUE. If they allow the TUE for the '14 season, there is no penalty to be handed down. If they don't allow the '14 TUE claim, WADA might recommend a suspension from competition. Since Stewart sat out so long, the suspension might be covered by his time out. Kinda like time served on a jail term.

That makes the most sense.

1. Yes he was in the wrong by not having his TUE in on time
2. WADA retrospectively allow his TUE but there is a X-Penalty say 4-5 races.
3. The races he missed including American MX , Potential MXoN selection MEC could count towards races he has missed due to provisional suspension
4. He lines up at A1

Which equates to, being in the wrong, punished by missing races, punishment already served go race., everyone happy.

Much like what happened to the Cronulla Sharks NRL team this year.
Missed the last few games, ready to line up next season.

I agree with both of you.... nothing will change...hell, even the sport if bicycling didn't do anything about Lance Armstrong, until he quit racing. It's about making money, plain and simple.

But he didn't miss any races due to his suspension.

He missed races cause he was "recovering".

If he doesn't get at least a couple of race ban from 15 sx then this whole thing had been a joke and why even bother with the testing at all from here on out.

There was never an official word on why he did not race was there?

If he was told he was provisionally suspended and sat out those races for any reason they would count as suspended races.

No different than say AFL or NRL, if a player was to get suspended and injured at the same time, the rounds they were going to miss due to injury anyway still count towards the suspension.

I can just imagine the meeting the higher ups had after hearing it was James Stewart "nooo! This was supposed to be a 10th-20 place guy so we could hang em high in the streets to show we mean business, but..... Since we stand to lose a lot of money here lets rethink this punishment"
