Common sense and legal decisions are 2 different things!, I dont know what his occupation is, I ve been around the legal systems for awhile now. Everyone has opinions, but unless you were there there will be 2 sides to everystory! And money speaks, no one expected jail time, but its a stupid thing for anyone to do, 10-50years old. Its all fun until it happens to you!
and I believe I said it was stupid, did I not?

Oh, wait, I did, see?

Now, all that said, was it a dumb thing to do? Yes, you bet 'cha, absolutely. Totally stupid.

Pretty much spot on as I see it.

No one ever said it wasnt stupid and I think James more than anyone realizes it. But to say he deserved jail time or whine because the prosecutor dropped it is wrong
And I do know what im talking about in this instance..my dad was a County Prosecutor, Municipal Court Judge in 5 districts and a well respected lawyer. I grew up going to court and have watched the somewhat same scenario over and over.
I agree it was stupid and his emabarrassment alone is something he will never forget....

And BTW BobbyM..I also stick up for them most of the time..basically I think they are a great family have watched them for many years and do understand the sacrifices they have given to be where they are..
Same goes for the Alessi's

I guess I am not sure what the issue is with what Dave said. A motocross rider was involved in some small trouble with the law, some people will jump on the wagon that Stewart should be in a shit load of trouble (after all he is not riding the nationals, rolls eyes face here) and Dave explained the situation of what happened, and what will probably happen now in lemans terms.

What do you think will happen if Dave is wrong about what he said?

Yep courts are pretty much a circus! Rich get off, unemployed people have an excuse, and the middle class get screwed because they are responsible and work for a living.

Here is how I understand it.

1. James never performed a "stop." He only flashed the lights, the car pulled over, they rolled up next to the car and yelled out the window "slow down." He never exited the car, he never pretended to be a cop (other than the lights), he never pretended to write a ticket, he did not pull behind the car like a police office would. So aside from flashing the light, he made no other action that could be seen as an attempt to impersonate a police officer.

2. He never "fled" the police officers, because they were in a personal vehicle, not a police vehicle, marked or unmarked. They had no lights or radio, which is why the police officers in a personal vehicle had to call 911 to report the incident. So they had no way to stop James, no light or sirens, so he had no reason to stop or indication to stop, therefore, he never "fled" or "evaded" police. He stopped for three toll booths, does someone fleeing police stop and pay tolls? Especially considering those three booths have speed-thru toll systems, where you do not have to stop if you have a "Sunpass" prepaid toll transponder? (why James doesn't have one, I have no idea)

3. Just because Rado had the light in his bag does not prove or mean they were trying to hide it, he could have been taking it with him to California, which is why they were headed to the airport. Can't prove he wasn't.

Now, all that said, was it a dumb thing to do? Yes, you bet 'cha, absolutely. Totally stupid.
Agreed. Dumb thing to do. Probably should have started and ended as a traffic ticket. If anyone else did something stupid like this, I am pretty certain it would not have made the papers. JS did something dumb. Beyond that, let's give him a break and not impose a penalty other than what the law calls for.

FYI: Florida Motor Vehicle Section
316.2397 Certain lights prohibited; exceptions.

(1) No person shall drive or move or cause to be moved any vehicle or equipment upon any highway within this state with any lamp or device thereon showing or displaying a red or blue light visible from directly in front thereof except for certain vehicles hereinafter provided.

[a bunch or non-applicable exceptions omitted]

(10) A violation of this section is a noncriminal traffic infraction, punishable as a nonmoving violation as provided in chapter 318.

Unlike you, I don't make odd vague references to things and expect everyone to know what I am talking about. I put out there in a clear manner how I understand things.

Every opportunity?
No

When I have some idea what's going on?
Yes.

Did I defend James when he crashed his way through the SX series?
No

Have I ever defended his TV show?
No, because I don't watch or like it

There are a lot of things I do not defend James on, and there are a lot of things I defend other riders on. If I know, I provide my input. If I do not know, I don't. If I think someone is incorrect, no matter who it is about, I say so.

Not my fault you see only what you want to see
fair enough..it must be me.

Personally I appreciate the 1% of posts here where the poster actually has some idea what he's posting about.

Now clear this up for me, why would an off duty police officer want to impersonate a sx rider?

If a couple of random strangers did this to your wife while she was driving the kids to school and were apprehended, would you still be defending them this way?

If not, why not?

Local article about the national problem with people impersonating officers. Stewart gets a mention on the last page.
In the paragraph before mentioning the Stewart incident the article talks about Police saying that the public doesn't take the impersonating an officer incidents seriously enough. So you would think they would follow that up with a horrific example where someone impersonating an officer pulled over an innocent family and murdered them along the road. Instead they mention Stewart where he pulled over two off duty officers and scolded them for speeding. Stewart should have received a medal for making a citizen's arrest on rogue cops who were breaking the law.

No, not everything being exactly the same, I mean replace your hero and Rado with a couple of guys off the street. So let's say me and my buddy ran up behind your wife and kids, put on some fake cop lights and got her to slow down, then pulled next to her and yelled at her before speeding off.

You wouldn't mind huh, you'd defend me the same as you defended Stewart in your post?

OK, so you wouldn't mind if Stewart did it, but if anyone else did it then you would.

Thanks for confirming your inability to see the act itself independently of the person who committed the act. This inability explains a lot of your posts defending Stewart over the last few months.

I guess Love is Blind.

are u serious? jesus christ ur thick.

for every person saying that dave has a love affair with bubba, theres plenty here who are just looking for an excuse to pile on him over nothing.

same goes for bobby. so much hate for these two built up over the years that noobs-turned regulars cant wait for the day when they can rat pack 'em. tho its not often you see dave and bobby going at it. just another case as to why the ban on noob bashing should be lifted.......if were not bashing them, we start turning on each other. very canabalistic days around here.

as for bubba, anyone who was rooting for this guy to get in trouble needs to get a life.

I'm not rooting for him to get in trouble at all. Makes no difference to me. I was just wondering if the people who are defending him on this issue would be so charitable if it affected a member of their family, so I asked the question.

It seems FlaRider wouldn't care if James did this to a member of his family. That seems really weird to me, but at least he's honest about it.

i guess i dont see the weird thing about it.

if he or anyone else did it to me or my family or friends.....

a) i'd be stoked i didnt get a real ticket
b) i'd be the biggest hypocrite in the world if i were to get pissed cause lord knows ive pulled plenty of harmless pranks
c) i'd probably deserve it cause chances are, those cops were driving like assholes, as they usually do

i mean, seriously, there are real problems going on in the world. at the VERY WORST, bubba was involved in a harmless prank. i could never see myself or any friend of mine getting pissed about this happening to them.

then again, my lil bro and his friends used to use a real cop light to pull over meth addicts back in my home town. they'd watch the meth heads ditch the car and go running off into the poison ivy to hide. then one of the kids would steal the car and they'd go have fun with it doing doughnuts in a dirt field. funny shit if u ask me, but not everyone shares our sense of humor.

What was the intent of the flashing lights...? Christmas...?...

What message was he trying to send with having said lights.......?

Was he acting as a person of law enforcement...? if not, then what...?

To use flashing red lights is universally illegal in this country, Why....? Because its what Law enforcement/Emergency personal uses.

Your logic could be the same used by a murderer or rapist caught early in they're crime, hence why there needs to be zero tolerance.

With that said, He should get a hefty fine, get his stuff back ( except the lights ) and be one his way. And his fine was bigger then any a court judge could impose......!!!!!!!!!!
Its not what you know, its what you can prove.

I saw that in a movieSmile

Mod Killer gets it...on several points

It was a stupid prank, no matter who commits it, but they never exited the vehicle, never approached the other vehicle, they just yelled "slow down" and drove off. Silly childish prank.

then again, my lil bro and his friends used to use a real cop light to pull over meth addicts back in my home town. they'd watch the meth heads ditch the car and go running off into the poison ivy to hide. then one of the kids would steal the car and they'd go have fun with it doing doughnuts in a dirt field. funny shit if u ask me, but not everyone shares our sense of humor.
Now that is a prank. LOL We had a radio station here called the bear. They had a vehicle called the bear mobile with a green light instead of blue and they would pull people over and give some kind of prize. Well these dipshits got the idea to pull people over at night, better off at 2 am on weekends as people was leaving the bars. Well, one night they pulled over the wrong guy. Dude thought he was getting a DUI and when he found out they weren't cops and was trying to give him a free frosty upgrade or something, he beat the shit out of them. I don't know how they didn't see that one coming.

Copied from MXA Florida prosecutors decided that there was not enough evidence against James Stewart to proceed with the case against him (which legal experts claim is not only airtight, but includes a confession). Stewart was arrested earlier in the year after authorities said he flashed red and blue police lights at a car on the freeway (the car just happened to contain two off-duty highway patrol troopers and an off-duty deputy). Stewart was arrested and his truck was seized. The state attorney's office said there isn't enough evidence to move forward, but the Florida State Trooper's want their legal team to review the decision.
You mean the legal eperts here on Vital.

Must have been the same experts that said the joint I just ate is evidence and in addition to possession I'll be charged with destruction of evidence even though I ate it before the cop could pull me over to take it into evidence or even know it was a joint.

are u serious? jesus christ ur thick.

for every person saying that dave has a love affair with bubba, theres plenty here who are just looking for an excuse to pile on him over nothing.

same goes for bobby. so much hate for these two built up over the years that noobs-turned regulars cant wait for the day when they can rat pack 'em. tho its not often you see dave and bobby going at it. just another case as to why the ban on noob bashing should be lifted.......if were not bashing them, we start turning on each other. very canabalistic days around here.

as for bubba, anyone who was rooting for this guy to get in trouble needs to get a life.
i respect dave like no other...but dave leaves himself wide open on here....time after time. and yes, if it was some lameass rapper fuckup instead of james dave would be asking for the death penalty i suspect...maybe not

and people really hate me on here, seriously?

wow i guess there are some stupid pricks on vital...not too mention dumbshitz.
