Jay, I know you have no beef, you have to much class...

It's John Perry... He seems to be a fucking ass hole.

I don't mind people questioning the obvious, The phone call to me was a surprise to me, as I was informed Saturday, at GH, that there was a meeting. John Perry, has no idea what he is talking about, he is just a loud mouth.

But when someone deliberately insults me, it's time to step toe, to toe, and make your point.

OK.....look at the dates

16 May 2010 Catalunya (ESP) Bellpuig

30 May 2010 GLEN HELEN

06 Jun 2010 France St Jean d'Angely

This means no week between California time and France time....No adjustment time
No shipping time, meaning extra works bikes will need to be built and shipped in advance...none of those teams will or can afford to express freight bikes and equipment, and even though Luongo pays freight for top 10 in points, he ain't going to do it express freight to get it all there and back.
It's a logistic and physical nightmare
Say you fly out on Monday, you arrive tuesday, jet lagged on wednesday, off to France Thursday, and practice/qualify Saturday, race a GP on a tough circuit on Sunday

I wonder if or how many teams or riders will say "no thanks"
Dave, does bring up a valid point. Racing on a Sunday in the U.S. then racing the following Sunday in France. Although the last 2 F1 races are back to back weekends with one in Brazil and the following week in Abu-Dhabi. I guess it can be done.

Dr. Feldcamp. and Luongo, seem to think it can be done...

The only thing that makes sense is it would be a perfect opportunity for Luongo to Slam MXsports and you know he's wanting to.

Here's the thing, Jay

Now of course I am not an attorney, but I do know that contract negotiations are typically done "in good faith"

If one end is playing the other, or negotiating a 2nd deal (as implied by Slow Pro) while negotiating the initial deal, that is not good faith negotiations and MX Sports has already spent a large amount of money on advertising, promotional and legal fees only to find out (if true) that GH was supposedly secretly negotiating a back door in order to drop the Nationals 60 days out?

Sounds like a few days in depositions, courts and a lot of billable hours on the horizon....in my opinion

and of course, that is if what Slow Pro says is true

if not, well....that could be another can of worms

John, they simply want the word out. It was talked about Saturday... Many people have made travel arrangements for the National at Glen Helen. This is a way to salvage said arrangements.
VitalMX, gets more hits than any other site. So where else better ?

I'm sure it was all done in good faith. There is no bad blood with MX Sports, and Glen Helen.
At least not from what I have heard, and read. So it's not to try and take away from MX Sports.

Well, we certainly haven't seen nor heard of a PALA race, nor have we been told it's been an ongoing negotiation, as we've been told on here regarding GH & YS

The other side of the coin is why wasn't Glen Helen offered a longer contract with a contingency it would be canceled if the desired improvements would have been made within in the agreed upon timeframe?

Now of course I am not an attorney either but logically this contingency contract could have satisfied both parties concerns.

I think you're overstating it, Dave.

Apparently the two parties have been negotiating GH's national status for some time. If they don't have a contract and there's uncertainty about whether the deal gets done, it seems natural to me that you'd explore your options, whether that's Glen Helen with YS or MX Sports with some other track. Or any other combination.

People seem to have a problem with that here, but it doesn't seem like a bad faith issue on the face of it at all.

There may be an issue if there is some sort of exclusivity provision governing the negotiations or some period of them.

The kind of issues you're talking about ~ MX Sports expending funds promoting ~ generally might be reliance damages in a fraud or negligent misrepresentation case, but reliance needs to be reasonable, and IMO in a contract situation it's hard to prove reasonable reliance when with whatever else the other party is telling you, it's also telling you there's no contract yet because of a fundamental disagreement on contract terms.

The thing is, people have been making a lot of knee jerk judgments without knowing what's going on at the core of the negotiations and the parties' positions and the parties' individual situations, which are always fluid. There's no need to ad another layer of that speculation.

So in your opinion, you believe MX Sports was well aware that GH was negotiating with YS for a GP to be held on the same date as the National they were already negotiating for, as well as advertising and promoting?

Really?

Rock, I think along with telling you that, I also mentioned that those sorts of arrangements are a litigation trap. There are times when that works, and times when it's untenable to the party that would have to terminate. There's a huge difference between being in a year to year contract and one in which a party dissatisfied with performance has to act to terminate.

How does it slam MX Sports? All it really does is provide YS with a ready made crowd.

I really don't see a lot of premier US riders showing up. They're invested in the Nationals at that point and there's a lot of risk to go with very little incentive.

Ha Ha... It's ok. I just got two calls... It's trickled down
One call from a whiner, the other confirming, it's all good.

I simply wanted people, that made travel, and vacation, arrangements, to know that all is not loss.

Glen Helen, has stepped up, and made something happen for the core, Motocross fans.

No I am not saying that. I am saying it all came together rather quickly to salvage the week end, in question.
GH printed a full page ad in good faith without a contract for the National, so I am sure all was done as an open book, and complete knowledge of both parties. (IMO)
Nobody seems to be angry at the track.

I am an optimist and a glass half full kind of guy so would like to think given the two parties involved in this contract it would have been a situation where it could have worked.
