Two observations from a non-American who likes your country.

You have had two consecutive presidents who both stole / mislaid / mishandled top secret documents. Really, are these two guys the best than you can muster from 300+ million people?

But the bigger thing for me is that for the last few years the politicians, media and large sections of the general population seem more focussed on scoring petty points against the other side than actually doing anything constructive for the good of the country.

Incredible. In a very disappointing way.

Trump will be covered under The Presidential Records Act AND the fact that representatives from the National Archives had BEEN AT MARALAGO, had SEEN the docs, decided NOT to take the docs BECAUSE Trump had REPORTED that he had said docs in his possession WELL BEFORE THE FACT...MONTHS BEFORE THE “Raid”… all of which is public info that’s been readily avail to ANYONE that wants to know…who actually “cared to know”…

Biden was The Vice President when HE TOOK Classified Materials that he had NO LEGAL RIGHT TO (and NO PROTECTION(s) via The Presidential Records Act)…btw, let’s revisit the fact that HE WAS NOT THE PRESIDENT WHEN HE TOOK THESE MATERIALS…

Classified Materials that he took ILLEGALLY.

Just thought it would be nice to finally put the facts and the real differences out there.

You may want to brush up on your knowledge of who can and can't classify/declassify documents.  I am not defending Biden, but he did have the legal power to classify material and to declassify that same material.  I am sure, however, that he didn't do that just as Trump didn't either.

Executive Order 13526

Please specify section and paragraph where it describes the vp gets to downgrade and declassify. I scrolled through the 30 pages on my phone and must have missed it other than where it talks about the original official or supervisory official. And the yadda yadda yadda

There is a review process for doing that.

A presidents term of office/power is limited.  The nation's security is on-going and constant.  Any, and I mean ANY fucker that thinks he is above the rules needs a boot so far up his ass you can tie the laces through his teeth.

So I'm going to question you on that.

According to you, the president can't declassified a document on his own for no reason other than he decided to do it?

I don't believe it. The president has the Supreme authority to do it.

Sorry...I should have been more clear.  The President certainly has the authority to declassify.  But, he can't just have his people throw documents in a box, have them stored God knows where, and say he declassified it.

There is a procedure.  It's not particularly complicated but strictly structured to ensure tracking and disposition.

Any document marked for declassification must be inspected to ensure it's disclosure doesn't reference other classified info.  Or to ensure that "new" info might require the old info to remain classified.

I'm not doing a good job of explaining this...my bad.  The bottom line is...the President has wide authority and power but it is not limitless.  He can declassify by following the proper procedure.

Or, I imagine, blanket declassification of boxes of documents without knowing specifically what they are.

And presumably a former President has no power of declassification at all.

Jesus we need to start doing exit interviews & property searches with these presidents, especially the ones on the way out.

Wouldn't need to if those people would just adhere to proper classified handling proceedure.

Apparently, the rules have been ignored for a long time.  This should be on the house floor for investigation asap.

If it isn't...that means neither party wants to be looked at very closely.

Me thinks this doesn't give Biden authority to declassify given the current info we have? I say this because some of the information was classified when he was a senator. At least that's what I thought I read.

WTH do I know though...

PART 3—DECLASSIFICATION AND DOWNGRADING Sec. 3.1. Authority for Declassification.

(a) Information shall be declassified as soon as it no longer meets the standards for classification under this order.

(b) Information shall be declassified or downgraded by:

(1) the official who authorized the original classification, if that official is still serving in the same position and has original classification authority;

(2) the originator’s current successor in function, if that individual has original classification authority;

(3) a supervisory official of either the originator or his or her successor in function, if the supervisory official has original classification authority; or

(4) officials delegated declassification authority in writing by the agency head or the senior agency official of the originating agency.

It's really not that hard or complicated to follow the rules.  I'd say what we're seeing is a complete and total breakdown of the "security" system.  Looks like they have castrated the folks put in place to control access, dissemination, control and storage of classified information.

When I was the guy charged with this responsibility...I had a few dickhead officers that didn't want to play ball.  They out ranked me but my trump card was..."You can do anything you want Colonel...just sign here saying you refuse to follow regulations".  Never failed to lock up every document...every night.Cool

Damn glad that I never had that opportunity.

I wasn't ever military, but I was building secret aircraft.

The Navy took 18 months to secure me because I admitted that I was caught with a joint when I was 16, and all charges were expunged upon my graduation.

They told me to never lie to Navy. I didn't. Took 18 fucking months.

They were coming by my bench daily trying to get me on the new program.  Sorry, I told the truth.

It was crazy.

Finally some captain called me into his office. He said that they were really seeking my involvement in this new program, and I should do what ever I could to be involved.

I said, "Captain, I quit giving a shit a year ago. I thought you were looking for good toolmakers."

He said ; "Sir, they believe they have found one".

One question. If you're at a party, and a joint is being passed around, do you partake?

I said... "Perhaps"

He fell back in his chair yelling "No man".

I  said "Never lie".

He asked me again.  I said no.

Back before secret email was common, every copy of a secret document that was produced was numbered and you signed for it. It was known who had what.  If that didn’t happen there were just a few copies of something and you had to go to a co trolled area and be given access to it.

Now, people are entitled to this information and convenience.  Just ask Hillary about her “classified”basement server.

I  said all that because the badge they gave me was never to be exposed outside the plant.

Imagine having to abide by the requirements of USC 18…and quite a few others…from the age of 18 - 50+…& then seeing this mad mess of stupidity?

From a POTUS having code word classified materials in a multitude of locations over TENS OF YEARS to some of those materials originating in his “Senate Years” & being removed -illegally- from a very serious “secure location” within the capitol…to his RIDICULOUS comments about how they were sorta safe because they were stored in the garage…with his Vette…and then there’s this…

Grown men come in here & provide cover for these actions.

Wow.

It’s nice too have the option to say,“No, thank you.”…which is something you lose when you’re no longer a civilian…I was told that by a true gentleman that I worked with as he transitioned form Captain to Admiral. The things he told me were as educational as life gets.

Good times.
