I-5 MX track horror story?

Is this going to affect the whole Gorman riding area or just the MX track? It's BS if this gets the whole place closed down.

People that sue because they were participating in something dangerous are worthless. The only time I ever have gotten hurt because of something messed up on a track was at a local supercross race. they had a step on step off that the step on lip was way way too abrupt. I was in the 1st practice, and so I rolled it a couple times, and then went for it the 3rd time around. the rear end immediatly kicked up (due to the face being way too abrupt) and I took a nice trip over the bars and hurt my shoulder. Did I sue? Nope. Any rider knows there are risks involved in this sport, and the way I see it, they willingly accept it.

It appears the track is now 'temporarily' closed ... per their phone and website.

Anyone know more about any of this? Any of you that emailed or wrote Daphne Greene get any response?

I feel bad about your friends injury, it's horrendous.

But, we all take risks every time we ride a dirt bike. You know that thing you sign when you enter the track? Ever read it?

Now I understand if they park a dozer next to a jump or shut the lights off on you while riding, be we have to assess risk while we're riding. Jump looks sketchy? Don't jump it. Track doesn't fit your style? Pack up and demand you money back. People need to start taking responsibility for their actions.

Again, I really am sorry about your friend.

It's a terrible thing that happened ... but how do you hold the track responsible for it?

I know it must appear hopeless for the parents right now .... but they need to stay strong and do the right thing .... and not allow some shark attorney to ruin other people's lives or livelihoods over it.

In life, it's fairly simple, even when it looks the darkest .... just do the right thing ... and you will find a way thru.

And I sincerely hope there's a special place down below for those greedy, avaricious, utterly-devoid-of-ethics attorneys that prey upon people in these situations.

That having been said I really don't know why you felt compelled to give Justin's name particularly since the three posts you've made are for the most part lacking any factual information except for providing his name.

I don't know anything about this situation but these things are usually much more complicated than they seem. I don't think its fair to judge this family or the track without knowing the facts, which nobody seems to know in this case.

Here's an example I dealt with first hand to show you how F*$cked things can get. Someone in my family was critically injured in a car accident(someone else was cited in the accident as the cause). The insurance was trying to find reasons to not cover my family member, of course. It was crazy the reasons they were trying to come up with. Anyway, we ended up having to get an attorney to deal with the insurance company. All we wanted was the proper coverage to be payed, but you have to "sue" them for this to happen if they refuse. Well, the insurance company then decided to counter sue us, the car manufacturer, another occupant in the accident, etc. They pretty much named everyone that was involved in their suit. It turned into a circus and they ended up pulling their suit but you can see, things can snowball in a hurry. Like I said, I don't know anything about the above track and stuff but who really knows what the situation is and what that family is dealing with. Yes, we all know mx is dangerous but when your kid is a injured in that way, it can get very complicated. Most legal cases you are not allowed to talk about the situation and believe me, its hard to bight your tongue when there are rumors and speculation about something and often its far from whats really going on.

Thats why we need a "loser pays" system. It won't solve everything but it would help.


The insurance companies routinely file suit to recover some of their losses not because they think they can win the case but because they know they can settle it and reduce the amount they will have to pay. They win we lose, again.

Loser pays would be a bad system as well. If you have a legit case and lose you are screwed?

An option for judges to put payment of legal expenses on the loser in the event of frivolous suits seems legit though.

I'd be happy to donate to the fund mentioned in the article, if I could be sure they weren't using the money for attorney fees.

First lesson I learned as a commercial insurance agent and dealing with attorneys...they will sue anybody and everybody for ALL the money in the world...its just part of it. Insurance for moto is expensive...A.) its dangerous...B.) moto lawsuits are never small...

Long story short, this kid's family did sue the track and many others, the track lost their insurance due to the suit, closed the track for a few weeks, secured new insurance, but are now in a pissing contest with the State over some unpaid bills, each side says the other owes them money.

The lawsuit is large and extensive, the family went after the track, the owner, insurance company, helmet company, etc...big $$

Thanks for the info. I had also heard that a lot of people got dragged into the lawsuit.

There really ought to be a way to still allow legitimate legal action but avoid what this attorney is doing .... basically just going down a list of deep pockets whether they had anything to do with the accident or not.

I still don't see how they have anything to sue over.

You are right...shotgun lawsuits. It's how it's done these days.

I wish we knew a bit more about the case and what the cause for the suit was.

That's BS I was there last week the prep was great, Pretty funny how someone from Canada is talking about A So Cal Track....You should only post about information you know to be true, instead of talking SHIT !

Sometimes lawsuits are initiated by the insurance company, whether the policy holder wants it or not.

You have to know that this type of injury racks up huge bills, and continues to rack them up for years.

When the insurance company sees a way to recoup their money, they go after everyone.

I don't know if this is the case in this case, but I'd hate to think moto people would initiate something like this.
