This was shot with US government equipment (i.e. taxpayer funded), so it's considered public domain. Not the same thing as the photo the OP is based off of.

OP and GuyB should make a business that sells drawings of really bad ass pictures. Guy shoots the pictures, OP draws them, and both profit from sells.
But in this case...... you get the idea.

I can understand the annoyance from the photogs after looking at it from that perspective. But at first I didn’t think OP had done anything wrong. Bad ass drawing(‘s), and you definitely have quite the eye OP, nice work.

Hey, he's got the talent to do something for sure.

I remember reading about this self taught artist that was selling Harley Davidson paintings he did, at flea markets.
This guy walks up and tells him you can't do that, I work for HD, and we don't have or let anyone do that.
The artist says "well, maybe you should".
This was back when they were working their way out of the AMF hole.

A month later they hire him, make him head of whatever dept that handles art and poster work.
And like a lot of top guys at HD, became a millionaire.

Motomo might be on to something....

Yea its ragnar , my favourite show too . It's made here in Ireland, I have loads of friends who do extras on it and on game of thrones

I'm actually not sure that the Dungey photo's not mine, but I understand Simon's frustration with people poaching copyrighted materials for whatever purpose, especially without asking.

As an example, there's a company that sells t-shirts, that has a network of Instagram accounts that poach photos of mine all the time. If I ask them to remove them, it's nothing but crickets.

Just curious if Cudby and others paid the rider for that picture that they would want someone else to pay them for?

Probably doesn’t matter....

Probably in the fine print when they pay to race that they give up thier rights to getting part of the cut from their images being resold!

Pretty sure the ama owns the right to their image. When I raced snocross you signed a paper giving them the right to your image.

Thank goodness the do-gooders killed this. He was well on his way to building the next Berkshire Hathaway of hand drawn motocross pictures. Building an empire on other people’s backs. Outrageous!!!

Whether Cudby, or GuyB shot the original photo doesn't matter, the image is copyrighted as soon as it's created, so someone owns the rights to it. The OP* offered to sell a reproduction of an image he doesn't own the rights to. Copyright issues and TFS not liking where TOE put strobes isn't even close to the same thing.

*I'm not faulting Brian; he said he wasn't aware he couldn't do that, and I believe him.

I know its not common knowledge but photographic rights are a real thing. GuyB and Simon Cudby are being paid to photograph the event and approved by the promoter to do so. All the participants are subject to the rules of the promoter, so yeah, Ryan Dungey doesnt have any rights to that image. The rights belong to the photographer, and anyone who he licenses usage of the photo (the folks who pay him).

Before the age of digital photography and internet, this was never questioned.

Should the photo be used as a model for a drawing? Sure, but with approval from the owner of the photo. 99.9% of the time its not an issue or its done on the down low and never even gets discovered, but sometimes it does. Photos are a product of the photographers work, just like software is a product of a developers work, its not free for the taking without some agreement.

I have seen Getty Images scan the web for websites that use unlicensed stock Getty images and send the owners invoices which they had to pay! These were stupid images on stupid small sites!

Its fairly obvious the artist had no malicious intent and proved it by offering to take it down. Its not Cudbys image after all.

Not everything that looks simple is. This is America and we can complicate anything, and the bottom line is money rules.

Brother painted this as a gift for me (actually going in my sons room). Thinking of an ispirational saying to go on the wall above it. Maybe something like "champions always find a way" or "never give up", or "dont be a wuss and pull off the track for something stupid" Haha.
