AKRON, Ohio - The homeowner who fatally shot a home invasion suspect in Akron earlier this month is now facing a voluntary manslaughter charge.
David Hillis, 21, turned himself in on Monday morning and appeared in Akron Municipal Court. A relative posted 10 percent of a $50,000 bond. He was released from the Summit County Jail around noon and was ordered to wear an ankle bracelet as a condition of bond.
According to Akron police, Hillis chased one of the suspects out of his home and-- from his property-- fired several shots.
Marcus Glover, 25, was shot in the head and died at the scene. His body was found in the backyard of a home two doors down.
Hillis killed Glover after police said he and another man, Terry Tart, 37, broke into the home in the 1500 block of Hilbish Avenue on Aug. 7.
Lt. Rick Edwards said Hillis was held at gunpoint until he turned the tables by grabbing his own gun, which caused the suspects to run out of the home.
Edwards said the Castle Doctrine gives homeowners the right to protect themselves inside their homes, but in this case, Hillis is not covered.
"You're not protected by the Castle Doctrine when the suspects flee your home or your property and your life is no longer in danger," Edwards said. "In this case, the suspects took off running from the house."
Hillis's father, Michael Hillis is furious that his son was charged and insists David was protecting himself in the heat of the moment.
"David was in fear for his life. These guys could have come back at any given time for the next six months when he was sleeping in the house," Michael Hillis said. "When your life is threatened or you feel that others have threatened you, you have every right to defend yourself."

On Monday, police also charged Tart with aggravated burglary and murder. Lt. Rick Edwards said Tart is facing a murder count because he was a co-conspirator in a home invasion that led to the death of another person.
On the day of the shooting, Michael Hillis—a former Summit County sheriff's deputy—was charged with misconduct during an emergency for crossing police lines.
A NewsChannnel5 crews captured several police officers tackling Michael Hillis after warning him several times to calm down. He's due in court for a preliminary hearing on August 21.
Hillis believes the officers overreacted and said he was trying to get to his son.
"That's all I wanted to see was his presence, his well being and know that he was okay," he said.

I'm all for keeping our guns in America, but I do share more liberal views than not. It's almost like I choose the best logical option, rather than choosing between two shitty sides lib and cons.
