He holds an FIM card and is/has participated in FIM activities.
It says:
These Anti-Doping Rules shall apply to FIM, each National Federation (FMN) of FIM, and each Participant in the activities of FIM or any of its FMNs by virtue of the Participants membership, accreditation, or participation in FIM, its FMNs, or their activities or events.
It also stats:
The FMN must guarantee that all Riders registered for a FIM License accept the Rules of the FIM, including these FIM Anti-Doping Rules.
Simply put the MX series is not an FIM series or one of its FMNs by virtue. The supercross series would all under that FMN category by virtue. The MX series does not. You do not have to have a FIM license to race the MX series.
So the rules DO NOT apply to the MX series.
As far as the "rules don't apply to the MX series"... I agree, they don't apply to the MX series(as I stated before) but they do apply to JS(or anyone else holding an FIM card).

So therefore they ARE connected. Which is why this is all so complicated. If his AMA membership is suspended, what then? Presumably as its a condition of getting a Pro Racing licence, then that is also suspended? This has been covered already a few times.
These Anti-Doping Rules shall apply TO ....... to is the operative word.
"The provisional suspension of James Stewart by the FIM as a result of an alleged anti-doping violation on April 12, 2014, does not at this time involve MX Sports Pro Racing or the Lucas Oil Pro Motocross Championship. At this stage in the results management process, the decision to compete at a National level remains with the athlete, FIM and WADA, as MX Sports Pro Racing is not a Signatory to the WADA Code and does not have the authority to impose a provisional suspension. Our sanctioning body, AMA Pro Racing, has indicated that it will not restrict Stewart from competing in the upcoming Tennessee National and will reevaluate its position pending the final decision of the FIM International Disciplinary Court (CDI). If this position changes we will be notified accordingly. Until then, Mr. Stewart is free to compete without restriction."
I don't understand this part..........................The provisional suspension of James Stewart by the FIM...... and then this.......as MX Sports Pro Racing is not a Signatory to the WADA Code
So if the FIM provisionally suspended him what difference does it make if MX sports is a WADA signatory?? It should only matter if they are an FIM "signatory", right??? Considering the FIM imposed the suspension according to the press release not WADA..
SX is an American Series that the world's best talent comes to. AMA Motocross is an American Series that the world's best talent comes to. Both are the pinnacle of the sport. PERIOD.
As far as I can tell the FIM brings very little to the party in either discipline and frankly they have done more damage than good overall since their involvement. No crime has been committed and the world isn't going to stop spinning if he races.
Let him race and if next year the FIM decides to get pissy about Stewart the Feld can tell them to "shove off, who needs you?"
It's about time someone stood up to their stupidity.
Isnt that what gives you wings?
Pit Row
Begs the issue of what Stew's obligation to the FIM are (and vice versa). But what you read is what people have been ignoring, or not getting, or pretending wasn't the case, which is that the FIM is not the boss of AMA Pro Racing or MXSports. The entities have been coexisting since the AMA's sale of AMA Pro Racing, which is easier when there isn't a hot button issue provoking one or both to take a stand about it.

Do we follow the letter of the law, or do we follow the spirit of the law? not everyone will unanimously agree on this one--there will be two sides
Logic would suggest we follow the spirit of the law, and so thats the side I'm on.
I don't think James intended to "enhance" his performance, and that fits in with the spirit of the law, which is to keep competitors from "enhancing" their performance. Not to keep people from taking medications and health supplements.
If he was going to cheat there are much better drugs out there to do it with.
These threads are amusing
They are going to defend him regardless man, it blows goats ...to much RED BULL money and not enough balls...
F it...I'm going riding.
Yes, someone should have read the WADA rules, if they didn't.
If he was shorted money on his check, yes he would probably want the money owed.
