Does the FIM run the American nationals? I didn't think so. He was suspended temporarily from the FIM, not MX Sports. Unless I missed something lately..

I think what the question here is since it was released post WADA test fail that James is taking ADHD medication and was just tested at Lakewood by USADA -and will most likely fail the test again - is there a point of him continuing to race if he will be reprimanded after the next failed test?

AMA Pro Racing and the AMA are NOT THE SAME THING - AMA Pro Racing was purchased by the Daytona Motorsports Group (DMG)

There is the AMA in Ohio that oversees SX. Then there is ama pro sports was spun off or sold to the Daytona motorsports group...for MX

In all honestly, I eagerly awaited Racerhead last week because I know Davey writes the intro and I figured the answer to whether James would be allowed to continue racing the Nationals would be addressed. But it wasn't.

If DC cant come right out and say for certainty whether his series honors testing from the SX series....well wtf? That should have been thought out ahead of time I would have to think. Guess not.Sad

In their rules on this sort of thing somewhere quoted and posted in one of these threads the FIM states that a person cannot race in any other professional series or event while suspended by the FIM. So he could technically race somewhere else but then he would be in violation of another FIM rule, thus subject to discipline from the FIM. Doesn't mean they would, maybe they will have an agreement beforehand but they certainly could.

Do you see where this appears to be headed? An athlete failed a drug test for a prohibited substance that he says he had a prescription for, but because the results took more than two months to come out, the series in question is now over and he's well into a different series altogether, one with a different sanctioning body and a different ant-doping agency. They say he's suspended; he says he will be at Muddy Creek.

At this point, I don't really know how this is going to turn out. The AMA and the FIM work closely together, the FIM and AMA Pro Racing not so much, so this is all new ground.

Doesnt matter what the ground is made up of, if a suspension only sprouts in sx dirt and not in mx dirt then there is a clear answer. Looks like we need a definitive P.R. from MXsports or whoever runs the Nationals to clarify whether James is allowed to ride Muddy Creek

Why would the FIM suspend stewart starting June 20th until? if they didn't have the right to do so...If they had no control over the Nationals then why wouldn't
they say he was suspended from all FIM events and A1 forward until futher notice?

Its all pretty easy to understand. AMA Pro Racing and AMA are 2 different entities and its been that way for a long time actually. And its been stated in a bunch of threads that they are not the same but I keep seeing people posting otherwise about FIM causing him not to race this week...bullshit. Stew will be on the line at muddy creek.

This.

Someone quoted it from FIM legaleese, then I re-quoted to highlight it. Somewhere in all those pages.

The Nationals (Davey) won't stop him, but if he does he risks further penalty from FIM. So with respect to the Nats, it's between James & the FIM - pretty awkward spot for Davey & 'his' series to be in. One more sign of how cluster@#$%ed this all is.

In the FIM code it says 2 yrs for a first offence.. section 10.2 but its not easy to follow

Also says in 10.4 if it was not intended to improve rider performance and he can show how it got there, it could be anywhere from a reprimand to 2 years

10.10 No Rider or other Person who has been declared Ineligible may, during the period of Ineligibility, participate in any capacity in an event or activity (other than authorized anti doping education or rehabilitation programs) authorized or organized by FIM or any FMN or a club or other member Organisation of FIM or any FMN, or in Competitions authorized or organized by any professional league or any international or national level event organisation.


Which is pretty darn far reaching.
