Plenty of laws violate the spirit of the Constitution. But lawyers are clever fuckers and they manage to write these laws in a creative manner that makes them “technically” constitutional. The first one that comes to mind is Social Security. It’s a retirement plan, but its called a “tax” when they take it out of your pay. It’s the only way they could make it constitutional. Still violates the spirit, but that’s what lawyers and politicians do: Exploit technicalities.

Would you like me to read the constitution in a "broad" way that benefits the Federal Government or the way in which it was intended to be read?

I think Gibby hates Mr. Cain, he keeps deleting the topics about him.

The obvious problem that should hit you in the face like a brick is that the supreme court is only one court and can only hear so many cases. The firearms ban in DC is a prime example of a law that has been unconstitutional for decades but only recently had a ruling by the supreme court.

So Borg's point that constitutional review should come at the time of a law's passage as opposed to after if has been bogged down in the lower courts for years and then backlogged for the supreme court and all along being abused has some merit. Probably not physically possible unless something else changes that prevents so many new laws being passed.

i believe ive seen this debate on these forums before.

i think the term "unconstitutional" has its own meaning. i agree with dave's first post in this thread, but with regards to this, we are arguing semantics.

"unconstitutional" in its literal sense is what dave is talking about. borg was referring to something a lil different. im assuming we all know what he meant?

i think its safe to say that there are plenty of laws in effect that we all think are bullshit and would like to see wiped out.

gimme my life, liberty, and property and you can toss the rest.

Serious????????????

Proposed List Of Demands For Occupy Wall St Movement!
Posted Sept. 25, 2011, 3:46 p.m. EST (9 days ago) by LloydJHart (Vineyard Haven, MA)

Demand one: Restoration of the living wage. This demand can only be met by ending "Freetrade" by re-imposing trade tariffs on all imported goods entering the American market to level the playing field for domestic family farming and domestic manufacturing as most nations that are dumping cheap products onto the American market have radical wage and environmental regulation advantages. Another policy that must be instituted is raise the minimum wage to twenty dollars an hr.

Demand two: Institute a universal single payer healthcare system. To do this all private insurers must be banned from the healthcare market as their only effect on the health of patients is to take money away from doctors, nurses and hospitals preventing them from doing their jobs and hand that money to wall st. investors.

Demand three: Guaranteed living wage income regardless of employment.

Demand four: Free college education.

Demand five: Begin a fast track process to bring the fossil fuel economy to an end while at the same bringing the alternative energy economy up to energy demand.

Demand six: One trillion dollars in infrastructure (Water, Sewer, Rail, Roads and Bridges and Electrical Grid) spending now.

Demand seven: One trillion dollars in ecological restoration planting forests, reestablishing wetlands and the natural flow of river systems and decommissioning of all of America's nuclear power plants.

Demand eight: Racial and gender equal rights amendment.

Demand nine: Open borders migration. anyone can travel anywhere to work and live.

Demand ten: Bring American elections up to international standards of a paper ballot precinct counted and recounted in front of an independent and party observers system.

Demand eleven: Immediate across the board debt forgiveness for all. Debt forgiveness of sovereign debt, commercial loans, home mortgages, home equity loans, credit card debt, student loans and personal loans now! All debt must be stricken from the "Books." World Bank Loans to all Nations, Bank to Bank Debt and all Bonds and Margin Call Debt in the stock market including all Derivatives or Credit Default Swaps, all 65 trillion dollars of them must also be stricken from the "Books." And I don't mean debt that is in default, I mean all debt on the entire planet period.

Demand twelve: Outlaw all credit reporting agencies.

Demand thirteen: Allow all workers to sign a ballot at any time during a union organizing campaign or at any time that represents their yeah or nay to having a union represent them in collective bargaining or to form a union.

These demands will create so many jobs it will be completely impossible to fill them without an open borders policy.

Some how this thing is getting sidetracked. This started out as a protest about "influence wall street has" over our government.

Who ever is taking this thing in the wrong direction is doing so purposely, and now that its heading into kooksville the media is starting to cover it.

Jim, it's no different than what happened with the tea party. What was originally a grass roots effort without any leadership and an open message got taken over by people with agendas, greed and then personalities and news organizations like Glenn Beck and Fox News.

I give Horndog shit at that other place, but I will give him credit in that he doesn't believe in or follow any "tea party leader" and doesn't believe there is a leader of the tea party movement.

That's what I was saying before, people come out of the woodwork to press their agenda, even though they were not the founder of the movement and not elected or agreed upon to be the leader, they just self-anoint and start acting as leader on their own and make demands, their own demands, and many are silly demands.

Jenny Beth Martin of the Tea Party Patriots is a prime example, she's making and spending money acting as a tea party leader, when in fact she isn't, she's an opportunist. She and her husband were essentially broke, owed the IRS over $500,000 and then founded the "Tea Party Patriots" and has made herself a "leader" of the Tea Party movement and is raking in cash as an employee of a 501c3

I understand what you are saying about the tea party, but I don't believe that this is the same deal. It took some time for the tea party to be hijacked. Occupy wall street went from "influence and holding people accountable" almost over night.

If this was on track with the original message, it could have been a real threat to both wall street and our elected officials..

This thing turned into kooksville and is no longer a threat to anyone. Something isn't right with this.

The big difference between the Tea Party and OWS is that the Tea Parties where multiple events all over the country, and time was needed to find and fund the right people to hijack the movement. OWS is a single isolated event and a lot easier to haul in a couple of bus loads of rabid wackos and alter the event overnight.

And that’s exactly how it works Dave. There are lots of people out there that are ready, willing and able to do the dirty work of cheerleading for their team. The only thing they lack is money. Where did Jenny Beth Martin get the money all of a sudden? Answer that question and you’ll be getting somewhere.

Mr. Jobs is worth something like 8 billion?

He earned it, created awesome products and provided countless jobs.

However these (mostly) young, just out of/still in college protestors are probably on their Apple I phones all day, doing whatever. Reaping the benefits from people like Steve Jobs.

But was not Steve Jobs just another rich, greedy, selfish, billionaire with too much money? Shouldn't most of his money be taken and given to the "less fortunate"?

I say nope!

The irony is sometimes too much to over look.

Oath Keepers is joining the OWS movement.

http://www.dailypaul.com/181721/oath-keepers-join-ows-anti-fed-mass-demonstrations

It will be interesting how the mainstream media handles this. Oath Keepers has been labeled as a radical right wing fringe group. If they want to continue to sell OWS as a left wing movement will they just ignore Oath Keepers, or will they now shift gears and say it’s a protest by crazy radicals from both fringes?

The mainstream media is not telling the real story that is unfolding right now. You guys need to pay attention.

Here's the Tea-Party's demands:

Demand One: End the bailouts
Demand Two: Reduce the size & intrusiveness of government
Demand Three: Stop the out-of-control spending
Demand Four: No government-run healthcare
Demand Five: Stop raising our taxes

Man, those are some crazy demands, aren't they? Those people are freakin whacko for asking for that stuff!!!! In fact, that is outright treason to demand something that treacherous!!!!!!! What a bunch of freakin terrorists!!!!!!!!

Well, demand 4 & 5 are bogus.

We don't have 'government run' healthcare, unless you are counting medicare and medicaid, and I remember seeing tea baggers' signs saying 'hands off my medicare'

As far as demand 5, tax rates are at their lowest now then in any of our lifetimes.

You tell a tea bagger that they have more take-home pay now than they did under Bush, and they'd call you a liar.
