He may be a nice kid, but if he knocked RV down from behind to pass him, he should be docked. It's against the rules to intentionally take out another rider. Stuff happens, and I'm not rooting either way, and I'm not attacking the kid's character, but if he knocked RV down to make the pass with the title on the line, the AMA should assume he did it intentionally and dock him at least one position.
