  Its that the rule  has no clear way to comply if You jump by mistake .And is written in a way that the AMA official interpreted it incorrectly ( in the opinion of MANY) / did not consider the penalties section of the rulebook when they made the choice to penalize Jett.

And that when the penalty was put into place it was made to stop people from purposely  and literally jumping the gate.  It was never intended to punish somebody who made a mistake like that. So they were not acting in the spirit of the rule as well.  

 

 When KTM brought it up, they were doing it for SMX points not MX points.  Hoping to give Sexton any advantage they could. Before Chase crashed out , that ruling had given him the sway in points he needed to be ahead of Jett going into SMX. It was never about this title, it was to give Sexton the advantage going into SMX. And it worked until it didn't.  

 

 I've also disagreed with how the homologation rule has been written without a penalty that was put in words until the current rulebook. That rule has NEVER been enforced and I doubt it will ever be. It could potentially  give a rider a much larger advantage than jumping the gate would, yet the penalty is  just a little more than a single OVERALL win bonus.  I think that rule and its relatively light penalty ( now that they have put it into printed words) is more of a marketing tool ( for bike brands) than a rule with a real impact on racing. Did Barcia get a penalty?  Other than basically a last place start?  Simply understanding how the self penalizing gate works would help to understand why it ended up the way it did and why Jett got the penalty.

There is either room for judgement or there isn't.   You can't have it both ways.   There is NOTHING under the current rule that Jett Could have done after that gate flipped forward.    Unless that " may" leaves room for interpretation of the rule which is what I am arguing.

No He could have let everybody go , but  the way that the AMA official read the rule that wouldn't matter.  After he had that Jump on everybody Jett was done, no way to recover. 

 According to him, he only had a choice to dock a lap, or DQ Jett.  NO MATTER what Jett did after his gate fell forward and he left the gate before everybody.

 Jett stopped and let all but 2 guys pass who had issues themselves and he likely didn't know  they were back there. That could have been enough if it mattered, The Official could have said he let what he thought was everybody by. But again he read it as he had to pick between the 2 options. Lap or DQ.

I agree with your argument. It’s a poorly written rule in regards to an infraction that’s horribly defined and was then very poorly interpreted by the ama officials. Especially so when the context is considered. 

Ultimately the rule says “may” which leaves it open to interpretation, so I would say the ama official made the wrong call. Problem is, is he is allowed to make the wrong call.

 Imo they shouldn’t have been, or be in such a rush to make a decision. Infractions like this should be go into a review process with a group of individuals before making a final judgement. No need to rush it.

He fouled the gate…. Then didn’t suffer the penalty designed in to the backward falling gate, and he crossed the gate before anyone else.  

Did Honda appeal?  Is it under review?  Did the penalty get overturned?  That tells you all you need to know.  I’m out.

You clearly didn't read my comment, a penalty for a "jump start" is defined in the rules, but what constitutes a "jump start" is not defined, rules should be clearly written, there should be no room for interpretation.

There should be no reading between the lines, there should be no implied rules, if it's not clearly defined, it is not a rule.

Mike Pelletier explaining it doesn't make it a rule, it makes it his interpretation of a rule, what if he said all blue bikes should be penalized a lap, because that's his interpretation of the rules, would you be happy with that?

Show me where "crossing the gate before anyone else" is defined in the rules...

Pelletier explaining how he interpreted the rules, shows how poorly written the rules are, there should be no need for an explanation, it should be clearly written in the rules.

I don't disagree with the need for a penalty, I am saying the rules need to be changed to define a "jump start".

Why would Honda appeal and deny Hunter  his first victory? Jett didn’t need the points so there’s really not much point appealing.

Mike should have worded it differently.  "Jett was in front of the gate when the gate dropped."  Which is the result of fouling the gate.

I think its pretty clear the rule needs to be rewritten to be more clear.

 The amount of people who know what they are talking about (   not saying I'm one of those people who know better, just that I agree with that opinion) that have said it should be rewritten along with so many different ways people have read what the rule means, with some using rules from their local orgs, or "common sense" to decide what they think it means. 

 

Perhaps have an asterisk to let people know there is another section that has the penalties and when and how they should be applied.   

 

When it comes down to it, if a rule is NOT written in the rule book,  it doesn't matter if it should be common sense, It IS not a rule. 

  

   I think that the involvement of gambling has increased the pressure to have quicker rulings when they will impact race results. I say this based off interviews with multiple industry people I have heard, where they speak about  how its changed things.
