When I bought my house 20 years ago I was under the impression that it was a hoa neighborhood. I heard it was 300 a year etc. Well as soon as I moved in my neighbors approached me and said don't sign up to the HOA it's a scam and this one is voluntary and less than 30% were signed up and no one on my street. They said a northerner moved there and started a "hoa voluntary club". I later find out a few of those in that 30% were in court battling to get out of it. Later the president was caught using the funds to remodel his home and landscape it and also didnt pay some road crew that was suing the hoa and the 30% were on the hook for losing the case. A new group of new northerners took over. It's been 20 years and never hear much about it until recently. My neighborhood is one of the nicest in the area. Homes average 1 to 5 mil and 1 to 5 acres all near the beach. I used to visit friends there while in high-school and never thought I could afford to live there let alone own 2 homes in there. The place has always been beautiful and it's kind of hidden with a beautiful tunnel of giant old oaks leading into it.  I always have people that say they have lived in the town for 50 years and never new it was back there. It's really beautiful. The bad part is it does flood easily and quite low land and the water is salty sea water so it's hard on everything. The mosquito and no see ums are crazy bad but everything else is great. Everyone takes pride in their properties and always kept nice. Holidays are festive, Christmas and Halloween hay rides and golfcart light shows etc. People have show cars, race cars, lots of golf carts, a few horses etc. Everybodys happy.  Well recently I get a knock on the door and a lady with blue dyed hair with a clipboard is there and says sign up for the new HOA. I say no thanks all is well without it. She says let me tell you about it... first it's going to be $3000 a year instead of $300, all trucks, boats and trailers will have to be locked in their secure parking area at a large monthly fee and anyone who has one in their driveway will be fined, 8 people will be appointed, 4 from neighborhood and 4 from the city to patrol neighborhood and write tickets for infractions etc etc. I say no thank you and no one is going to agree to that when everything has been great for ever. I am in the back and noticed only one signature on her clipboard. She then says well too bad because the contract where the neighborhood votes ends 2025 and then the board only votes and it's happening. Wow move here and ruin a perfect situation.

This reminds me of our current government. Glad I have been slowly moving to farm but dam I loved it there. I'm going to sell one and rent the other if it's financially possible but wow it's like a hostile takeover.

Most people, and particularly most vital users, don’t like to hear the phrase “hire a lawyer.” But, considering you own two houses in a neighborhood with a $1,000,000 cost of entry, you should probably take manny’s advice. You stand to lose more than what it will cost you. Protect your property rights.

Can you ammendment your title to the property with a stipulation that it can never be part of a collective HOA? If enough neighbors do the same, where would their power come from?

I'm not sure but there is 70 houses not in the voluntary HOA and a lot of lawyers so we will see. I'm hoping it's squashed before then. My main house is getting ready for sale. It was damaged by the hurricane but about back to before, the other is newer CBS and on a hill so only had water in garage and perfect condition. My mother in law lives there but after my house is built at the farm I'm going to move her into the current home at the farm and rent that one out if it's financially profitable which will be difficult if this HOA situation goes through and might just end up selling it too.

I get the general idea behind them....look at the flip side.

People  parking cars in the lawn, too many people living in one home, letting the appearance of your home go to shit, garbage strewn about, RV's in the driveway/on the street.   (I personally hate RVs)     Hell, my BIL has a neighbor who painted their house purple with pink trim....WTF. 

The problem with HOAs, the people who run them are generally power hungry little fuckheads.

It depends on your neighborhood. If you live in cookie cutter houses, you might want uniformity. If you're in country rural, not so much.

Agreed.   

However, when visiting my other BIL who lives in Kentucky, driving along out in the country, you see these beautiful homes with pristine white fences on huge lots.    ...and then next door you have the shit wreck dilapidated house, a bathtub in the front yard with a transmission in it and rusted cars everywhere.       It's completely bizarre.

FLmxer, you need to check the CC&Rs for your neighborhood that are set by the city or county you live in. If those say an HOA can be formed with some percentage of agreement between the homeowners, then it is possible you can be forced into it. 

If there are no such regulations, any HOA must be at-will and unless you sign, you are not bound by their rules. That's the way I understand it, anyway. Florida may be different.

Not really, but not enough so that I will stick my nose into their business and tell them how to take care of their place. I worry about my place and my place only. Only reason i care about my neighbors is when their pit bull comes over and bites me or their delinquent kid likes to come over at 2 in the morning to take a tour of my garage.

You mentioned how bizzare you think it is that a nice house can be next to a dump in describing your brother in laws living location. A once rural location where nobody wanted to live became attractive when suburban areas became crowded... (and started HOA's)....making the cheaper land out in more rural areas seem attractive to live and build on. Thus an estate with a nice house next to a single wide with tires on the roof and dead cars in the front yard. The situation will continue to evolve as the folks with money offer those who do not have money an ever increasing amounts of money for their place.

Dont they call that gentrification in urban areas of color?

Agreed.

That's a big part of the problem,  those of us who live in the country do so because we don't care what out neighbors do as long as they don't care what I do. People lookin for their 5 acres of paradise move out here and want to change everything.  Oh you hog manure smells, your old truck that you use doesn't look good, and let's not forget " do your kids have to ride those dirt bikes? They make noise and dust.

I try not to even look at my neighbors property good or bad. Non of my business. I won't bother you ever, please don't bother me. I'll help anyone of them in a second and know they will do the same but until then I will try to not even look your way and let everyone do as they dream.

Dude.     I grew up in a rural area.     We had horses, goats, chickens...etc etc.   We had trucks and tractors and gardens.   We built our home from the ground up....living in trailers until it was completed.  

 

I'm talking about shitholes and people who let everything turn to shit....not the people with the working property.     You don't see HOAs so much in rural areas anyway. 

I hate HOAs......but I can see why some places need/want them.

Exactly why us farmers here buy up 5 acre pieces so that sort of thing doesn't happen.

Easy on the "dude", like I said that is part of the problem, I wasn't pointing at you to want to control the narrative of your neighbors but you seem like that's what you want. We all participate in a sport that outsiders want to shut down, same as people who want to live how they want. If you don't like it don't move there, if your passing through go a different  way. I believe in live and let live.
