I can't believe the parallels between Ty Masterpool and Kyle Regal.  Parents buy a training facility in Texas, kid gets signed and quickly cut from every team he rides for (including Star).  Rumors of eccentric parents that are heavily involved in his career.  Then goes out on his own mostly stock bike and stomps a mudhole in factory guys a couple times.  The only difference is Kyle landed on the podium a couple times with more talent around him.  But he faded away pretty quickly after that except for a couple year run in AX.

This is just incorrect Tyler.  They sign a contract and it has nothing to do with a W2 vs. contractor.  Example:  KTM riders are required to train at Bakers Factory and it is in their contract to do so. They are required to do be at test days, training requirements, and contracted to attend certain races and other events.   There are also conduct clauses were they have to behave professionally and be active and appropriate on social media.  It is much more than show up at races and do some brand promotion lol.

let me know if that contract has actually been adjudicated or not. you can contract for anything... at the end of the day, it's a fact finding that has to occur to determine whether contractor is constructively treated as an employee or not and whether the contract is voidable.

It has nothing to do with voiding the contract, it has to do with whether the riders are subject to wage and hour laws, payroll taxes, workers comp., etc.

OEMs try to have their cake and eat it too. they want relatively full control over the riders, but don't want to be subject to that stuff you mention. i'm arguing that they exert MORE control over riders, generally, than they would otherwise get away with under a contractor-contractee relationship were a contract ever adjudicated.

He's probably thinking of the Merge Racing Honda in 2010
