Your analogy is correct in that in a court someone would have to pay for the holes in the wall even tho they were invited in but if while in court I could prove it was actually my house because you didn't pay me for the house no payment would then be demanded.

In this case they did not destroy the bike and in no way would they win in a court of law damages, with all the facts on the table.


This is an issue tho of MXsports determining that they should limit access of a company and its employees due to its actions, in an isolated instance with a rider who doesn't even ride their series anymore.

"Did you grant permission for them to plug into your bike?.....yes?.....ok, you guys take your dispute somewhere else! If anything like this ever happens again in our playground by either one of you, you won't be invited back!"

It's just not that black and white. If your only criteria is that he "affected" the outcome, did Kawasaki affect the outcome when they terminated DM's contract that close to the race? Obviously the outcome was different without Davey in the mix but nobody is going to say Kawasaki changed the outcome of the race. So there is more to it than that.

It's just not that black and white. If your only criteria is that he "affected" the outcome, did Kawasaki affect the outcome when they terminated DM's contract that close to the race? Davi got his ass fired , no one Sabotaged the bike a hour before a moto

American Pharoah won the triple crown... The owners could of seen fit to replace the jockey before the race...
If the horse got second, NO ONE effected the outcome of the race...

Now if "anyone" tied to the Belmont Horse Race or NOT stuffed cotton up the horse's nose before the race that's effecting
the outcome of the event...
and would be effecting the betting public which would cause someone to go to prison for a long time...

I'm using the horse race as a "example" that horse is being monitored 24/7...

The Jockey is the same as Davi... American Pharoah is the same as the Monster Energy Kaw 450F...
You CAN'T TAMPER with either one before an event....

People have fantasy picks (some money is involved) there's contingency money involved...

After hearing both sides, I believe if Lieb is banned, than Clason (and team) should be suspended also until this issue is resolved by both parties. I hate to say that, and it sucks that the rider would have to pay the price, but he is essentially riding stolen property.

Lieb should have pursued a solution within the legal system, and then presented documentation of the legal proceedings to MX Sports for their decision on whether or not a rider should have been allowed to compete on a stolen (or at least contested) machine.

Either way, this sucks for all involved. Just pay the guy already so everyone can move on!!

in theory he took the keys back to his own 'car' until the person owing them money would hopefully pay him. and it looks like he was trying to get paid there on the spot.


and why is it the clasons 'property' MORE than its leib's?

sounds like don had more 'ownership' than they did, thus not taking anything of 'theirs' away from them to begin with.

The point is, Don messed with the bike in the pits. He should NEVER, EVER have done this period, for whatever reason. EVER!

When he couldn't get in touch with the granny, that is when he should have filed in court.
Just like owing on a home. If you don't pay it off in full the Bank takes it back and sells it, THEN gives you whats left over.

So if the numbers were ground off, why didn't the LEO get involved? They were there, they heard DL's sorry tale. They probably didn't do anything because they didn't see anything wrong.

If you were the LEO would you rather listen to DL crying like a baby, or go watch the racing?
