Same thing happened in Ida with the track they wanted to build next to US23, a quarry, RR tracks and busy road. They had one neighbor causing all the issues, rounded up the other neighbors and hated it before even hearing about it. Now most of the neighbors said they dont have a issue with it and regret agreeing with that looney. Also the judge broke laws and procedures within the twp and county. Once he was being challenged on that he dug his heels in deeper to avoid admitting he was wrong. Basically denied the guys who owned the property even allowed to ride on their own property.

Keep in mind the track has been there since the 1970s.
Noise was the complaint.
And this was back in the 2stroke days when bikes were quiet compared to 4 strokes.

Curtis - I'm part of the Irish Hills track as well. PM Muezh or myself if you have any questions. Fought the battle for almost a decade before getting a court order. We still ride albeit A LOT less than we used to.

If this is the same track that MRA (Barry Mayo) used to sanction back in the 80's -90's I raced a few events there...

Used to race Milan Fri night then Delta Sat then either Irish hills, Log road , Mustang acres, Baja, Morelands on Sunday...Man I loved those days...LOL

Then go to work on Monday with NO aches and pains. If I did that today I would be in the Hospital for a week recovering Laughing

I hate to say it but if you're counting on that "accessory use" zoning you are going to be very disappointed.

If you had just cleared some land and slowly built it up into a track you may have gotten a pass.
Bringing in a company to construct a purpose built track whether it is for practice or not may have doomed you.
If you didn't have a permit specifically listing a motorcycle track as what was being built, you are not going to win this.

Again I hate to say it because I love moto and think you should be able to do whatever you want with your property....unfortunately the law is not going to be on your side with this and I would expect they will issue you an order to restore the property.

If you need an acoustics expert, the National Council of Acoustical Consultants has a national directory: http://www.ncac.com/directory.php

I get the impression that the town board needs to be convinced that the track will not be too loud. An objective definition of "too loud" might not exist in the absence of a noise ordinance. Getting a clear definition of "too loud" from the board, based on municipal, county, or state law, or based on legal precedence might help prepare a winning argument.

Acoustical consultants can estimate how loud the track will be at neighboring properties, compare that with ambient sound levels or with relevant noise ordinance laws, and recommend noise mitigation measures. That's what I do.

Attorneys can help with the legal maneuvering. I think you need an attorney more than an acoustics expert. Hope everything gets resolved.

Drive 10 tractors up with cow / hog/ chicken shit about 1 hour before the meeting and spread it in the parking lot , let them have"a little taste off what's coming" if they would like to peruse the subject matter , YOU ARE NOT DEALING WITH RATIONAL PEOPLE THEY ONLY SEE THERE WAY, you need to keep planting the seed from day one . This is from personal experience ,my family had a 40 acre weekend house up state ny after 20 yrs off riding bikes there, a lawer couple from NYC bought a 5 acre place one winter for there weekend retreat and where not happy when spring rolled around , I was a nice guy and told them most Sunday's I would not ride , that wasn't good enough, they thought they would run my money dry in attorney fees guess what next sping , there was new home owners,I paid every farmer around 10 dollars a load off manure to spread in the feild in front off there house works like a charm !!!! Use your brain don't give it all to the lawers , your local farmer works damm cheap

DEQ and County Soil and Erosion Control have both visited the site due to "calls" about potential violations...all is good, no issues...cases closed. Talked to several neighbors (cordially, of course) in the last couple of days and all admit/acknowledge that my son is good...AND that the bike is not loud. The neighbors I spoke with all said they were concerned that we would be holding race events and such...assured them that was not the case and they are now supportive, or at the least do not have a problem with what we have going on...

Well it didn't go as well as everyone hoped for. The "board members" already had their minds made up. It seems like the next logical step will be court. I'd like to thank on Curtis's behalf all who came out in support. It's great to see the moto community pull together for what they are passionate about.

We fought a vicious battle for years. Again, PM Muezh or myself if you have any questions. BUT if you want to ride when you want, you should hire the most pit-bull attorney you can find/afford and squash this asap. This will drag out if you don't. Do not continue to ride whenever/however you feel. They are watching. Some of the "anti" folks will make it a mission to shut you down like your a criminal. I would keep all info from here on out private. You got the word out, nothing the moto community can do for you now except to donate attorney fee $...

Well...not what we hoped and prayed for...the board was dead set in their attorney's opinion to shut us down. They are clear on one thing though: "I fought for this country and I will fight for my family...we will not go down easy." Court bound. P.S. thank you to all those that showed up in support of our family and what we are doing...we greatly appreciate it.
