A civil trial, unlike criminal court, does not provide guilty/not guilty verdicts; levels of fault can be attributed to one or both parties. In this case, the plantiff only needs to demonstrate a plausible case, i.e. is it possible that Stewart moved up the track and gunned the engine in response to Ward's actions?

Most posts assume Stewart did not see Ward and did not intentionally move up the track. However, most people would also agree that it's not outside the realm of possibility that Stewart took an aggressive stance with his vehicle. And that's enough to launch both a criminal investigation and civil trial, regardless of how sprint cars are driven or their visibility.

I've been reading this all along and i can't figure how tony stewart can charged with anything . The kid targeted him and ran out in front of his race car , how does anybody know if tony was making adjustments to himself or the car and took his eyes off the line because they had just gone to caution ? If somebody runs in front of my car on the way to work on the thruway ,am i going to be sued?

How fast do they run under caution? I'm guessing 45-50 mph?

You know, I couldnt really say, never really thought of it in terms of MPH, most racers think in terms of lap times when talk about speed. And to some extent it depends on who is in front when the yellow goes out setting the pace, and how fast a track official will let you get away with. Ive seen tracks they will damn near make you stall the car on yellow, and others that are clipping along pretty damn fast under caution. Most of the time (especially mid race and later) guys will try to keep the pace pretty brisk on yellow cuz the engine is damned hot and will overheat once you loose that air coming in. Sprint radiators are tiny and once you take away the wind and RPM pushing the water thru the tiny system, it gets hot, and fast.

Of course, all of that will have be confirmed by Cajun as accurate or not. *sarcasm*

Based on this photo, the view from inside one of these things is far less than ideal. Probably much worse with some rear offs on your visor.

Just curious, because I have not seen the entire race, was Tony Jacking with Ward throughout the race? Would he have known that Ward was going to be pissed at him for clipping his front tire? If Tony didn't know what he did then why would he even think about "sending Ward a message" as everyone is assuming?

Tony did not try to "clip" anyone. Sprint car racers do not try to touch, you will end up destroying your car and many others.

He leaked up into Wards line, was spinning trying to regain speed and consequently pinched Ward off against the wall (you cannot see to your side in sprints and Stewart could not have seen any of it) Ward didnt brake or lift and bam. When you race sprints you ALWAYS are looking for cars to leak up into your line exiting a turn when you are up top, thats sprint racer 101.

Yeah, I didn't think about that...I guess that's "open wheel 101"!

So were they jacking with eachother throughout the race before the crash?

Seems like people are jumping to conclusions about another racer wanting to run someone over with an 800hp controlled explosion...like the guy doesn't have enough other stuff to worry about. People are assuming Tony knew Ward was out of his car because he saw him from 1/2 a track away in a car with limited visability, poor handling at slow speeds and no radio. He was also coming around a turn in mid pack so you have to think the other cars were blocking the veiw down the track where he might have spotted Ward.

Theres no doubt that Smoke is a hot-head and guys will certainly cut you off while on the track, block your lane, put a aggressive slide-job on you, all of that, but contact is never considered in any form of open wheel stuff. After watching the video many times its a typical dirt track scenario, the middle line looked dry-slick and trying to exit in the middle you will spin and leak up (unless you got lucky and hit the setup for that night), Ward was up near the cushion and Smoke slid up and Ward didnt lift. After 35 years around the dirt track, run out onto a track with cars lined up and going, darting in traffic and taunting a driver/car. Blink

I've been racing MX for 22 years, with some pretty good stats, Why wouldn't I be on this site?

I'm sure I could explain it well. I had to take a pretty good bit of physics and aerodynamics courses to get my degree in professional aeronautics...
