You seem like a nice guy so why wouldn't you just sit a few seats over rather than ask someone to move so you can sit in a seat that is not yours at the moment.

Btw I have had this happen to me and I politely moved. I just don't see the point of disturbing people to claim a seat during open seating when actually all of the seat are claimed per say.
