I am wondering about the punishments though for coming up hot. Does the FIM hand out the punishments or the Agency? As long as the punishment aspect is not FIM, this is great news.

The penalties are prescribed by the WADA Code, and because the FIM retained the results management responsibility (i.e., penalty enforcement) it is the FIM that enforces those Code penalties. The FIM got in hot water and lost a case to WADA before CAS when the FIM tried to disregard the Code penalties and go light on a rider.

There are two issues here:

* Are the penalties in the Code appropriate for motorsports where competition is less about a few big events in a year and more about 30 plus events within a year.

* Regardless of the penalty, does the entity that manages the outcome of a positive result have a fair/speedy process to resolve fault and penalty level within a reasonable time to provide due process to athletes who are found at fault and, more importantly, to athletes ultimately found to be without fault and eligible for reduced penalties.

The answer is no to both questions, but reforms to the latter issue of process would go a lot further toward protecting the riders' interests.
All they have to do is write in a couple sentences about timely notifications. They obviously already no how to write codes and requirements for the athlete. How about add a couple for their own behavior? Simple fix really.

In the end the time suspended is the same so what does it really matter?
In Craig's case he got to keep racing all that extra time. So for him not getting notified was great.

What about the now looks like poor innocent riders who are suspended or been that way for some time, their careers affected etc loss of earnings, contracts, future contracts all affected. I feel sorry for them, in some cases they allege to have taken cold or flu remedies to get pasted & banned! by these dick heads.

Maybe there's going to be a few court cases on the back of this, but still doesn't help a rider whos now yesterdays man ?
