musical plagiarism

I just heard "my Sweet Lord" on the way to work and right away thought of the plagiarism charge that Harrison paid a settlement for, although I couldn't for the life of me remember what song he was supposed to have copied. I just checked and found it was "He's So Fine" by the Chiffons. I don't hear it at all.

A much more obvious case to me would be the Strokes "Last Nite" and "American Girl". both of the artists have commented on it, so qwhy no lawsuit there?

Seems like writing songs can be a very slippery slope- how much can you allow your influences to seep in.

You can steal what ever you want, as long as you change something before you hit the end of the eighth bar.

I don't understand why Warren Zevon hasn't sued Kid Rock...

If you can't hear "He's So Fine" hiding inside "My Sweet Lord" you need to clean out the ears. It's all over the verses and choruses. All he did was change one or two rhythms. Write down the chords and melodic line and it will be obvious.

Whether that holds up in court is another thing. I don't recall how it turned out but I do know that a lot of these guys will start off with a song out of a fake book - a collection of standard songs - and then just tweak a few things here and there.

You cant copyright a group of chords or the chord structure of a song. The only thing in a song you CAN copyright is the up front melody and the lyrics.

He is dead.

I always play the old stuff and that song started and my son said " I like this song " I was like allright he is picking up on some of the stuff I like and then Kid Rock started, it made me sick.

Define melody.

If I use the same notes from the melody ... but change the rhythm around, is that considered plagiarism?

Probably depends on how different the end product sounds. A sticky area for sure. I know there have been some pretty wack plagiarism cases over the years. The one with Fogerty being charged with plagiarizing himself comes to mind.

I was going to say the same thing. That song pissed me off something fierce the first time I heard it. All I could think was I hoped Queen/Bowie got plenty of royalties off of it.

funny you say that, because Amercian Girl is probably my favorite Petty song and I have been listening to the Stokes alot in the last year, and I never noticed it until i read an interview with Petty. He didn't seem upset about it though

"Last Nite" is a single lifted from Is This It, the debut album of acclaimed American garage rock/post-punk band The Strokes.

In March 2005, Q magazine placed "Last Nite" at number 66 in its list of the 100 Greatest Guitar Tracks. In September 2006, NME placed "Last Nite" at number 1 in its list of the 50 Greatest Tracks Of The Decade. In May 2007, NME magazine placed "Last Nite" at number 9 in its list of the 50 Greatest Indie Anthems Ever.

The Strokes riff in this song is very similar to Tom Petty and The Heartbreakers' "American Girl." In a 2006 interview with Rolling Stone, Tom Petty said "The Strokes took 'American Girl' [for their song "Last Nite"], and I saw an interview with them where they actually admitted it. That made me laugh out loud. I was like, 'OK, good for you.' It doesn't bother me." [1] The band originally did not want to make a music video. When they asked if they could just perform it live and got the ok, they were more than happy to.

I believe it I just do not hear it. Maybe I am thinking it was going to be as obvious as Ice, Ice, or the Zevon / Kid Rock deal.
