Copied from MXA Florida prosecutors decided that there was not enough evidence against James Stewart to proceed with the case against him (which legal experts claim is not only airtight, but includes a confession). Stewart was arrested earlier in the year after authorities said he flashed red and blue police lights at a car on the freeway (the car just happened to contain two off-duty highway patrol troopers and an off-duty deputy). Stewart was arrested and his truck was seized. The state attorney's office said there isn't enough evidence to move forward, but the Florida State Trooper's want their legal team to review the decision.

I thought it was odd that it was let go. Didn't comment on it before as I was pretty much sick of the topic. There was definitely sufficient evidence, though. And that's the last i'll say about it.

Here is how I understand it.

1. James never performed a "stop." He only flashed the lights, the car pulled over, they rolled up next to the car and yelled out the window "slow down." He never exited the car, he never pretended to be a cop (other than the lights), he never pretended to write a ticket, he did not pull behind the car like a police office would. So aside from flashing the light, he made no other action that could be seen as an attempt to impersonate a police officer.

2. He never "fled" the police officers, because they were in a personal vehicle, not a police vehicle, marked or unmarked. They had no lights or radio, which is why the police officers in a personal vehicle had to call 911 to report the incident. So they had no way to stop James, no light or sirens, so he had no reason to stop or indication to stop, therefore, he never "fled" or "evaded" police. He stopped for three toll booths, does someone fleeing police stop and pay tolls? Especially considering those three booths have speed-thru toll systems, where you do not have to stop if you have a "Sunpass" prepaid toll transponder? (why James doesn't have one, I have no idea)

3. Just because Rado had the light in his bag does not prove or mean they were trying to hide it, he could have been taking it with him to California, which is why they were headed to the airport. Can't prove he wasn't.

Now, all that said, was it a dumb thing to do? Yes, you bet 'cha, absolutely. Totally stupid.

Just because the prosecutor decides not to go forward doesnt mean he still wont be paying fines etc. He's just not going to trial but will still face traffic court (at least thats the way it is handled here). Happens quite alot when either there is not enough evidence to convict (and im sure the proscutor realizes what type of legal representation James can afford) or more than likely since its his first offense they will go thru PTI and handle it that way.

Come on people, really. Are you hoping and expecting James would get jail time for this? He has no record, pretty much anyone in that situation would get off with a slap on the wrist at worst. Probation, maybe a small fine or license suspended. It just so happens James has a little money and on occasion makes some good charitable donations, so it gets thrown out. I think any damage that was gonna happen had already been done, it was carried on the news after all.

I thought the whole thing was overblown from the start. Impersonating an officer to me means a lot more than red and blue flashing lights, I don't care what the stupid law says. I think justice has more than been served in this case for the embarrassment alone. I'm pretty sure James has learned his lesson and won't ever do it again. I would hope that anyone in the same situation (but less well to do) would have the same outcome. On the scale from Parking Violation to Murder I would put this barely above parking violation.

I think in this case they realized that the police wasn't going to come out looking very good. From the various reports it sounds like these guys were driving like idiots.

What was the intent of the flashing lights...? Christmas...?...

What message was he trying to send with having said lights.......?

Was he acting as a person of law enforcement...? if not, then what...?

To use flashing red lights is universally illegal in this country, Why....? Because its what Law enforcement/Emergency personal uses.

Your logic could be the same used by a murderer or rapist caught early in they're crime, hence why there needs to be zero tolerance.

With that said, He should get a hefty fine, get his stuff back ( except the lights ) and be one his way. And his fine was bigger then any a court judge could impose......!!!!!!!!!!

Pretty much spot on as I see it.
Common sense and legal decisions are 2 different things!, I dont know what his occupation is, I ve been around the legal systems for awhile now. Everyone has opinions, but unless you were there there will be 2 sides to everystory! And money speaks, no one expected jail time, but its a stupid thing for anyone to do, 10-50years old. Its all fun until it happens to you!
