Wow...this cop was quick. Seems totally justified. What was this guy thinking, pulling out a pellet gun? Maybe cop cameras are a good idea, because it can obviously show what happened.

The cop made sure his ass wasn't getting up either.
At least the guy did everyone in the restaurant a favor and waited until he got outside to really demonstrate his idiocy. That could have ended badly if it happened inside.
Moral of the situation, don't pull out anything that looks like a gun when you have to deal with the police. By the way, it was an airsoft gun.

The problem that I have is that you don't go rushing in when you know that the person has a gun, fake or not. That kid literally had no time to react. Had they stopped several yards away and put the car between the kid and themselves and commanded him to drop the weapon I'd almost bet that he would have complied, but we will never know.
BTW, it was also documented at the police force that the officer was at previously that he wasn't suitable to be a cop because he had impulse and decision making issues.
In a memo to Independence's human resources manager, released by the city in the aftermath of the shooting, Independence deputy police chief Jim Polak wrote that Loehmann had resigned rather than face certain termination due to concerns that he lacked the emotional stability to be a police officer. Polak said that Loehmann was unable to follow "basic functions as instructed". He specifically cited a "dangerous loss of composure" that occurred in a weapons training exercise, during which Loehmann's weapons handling was "dismal" and he became visibly "distracted and weepy" as a result of relationship problems. The memo concluded, "Individually, these events would not be considered major situations, but when taken together they show a pattern of a lack of maturity, indiscretion and not following instructions, I do not believe time, nor training, will be able to change or correct these deficiencies." It was subsequently revealed that Cleveland police officials never reviewed Loehmann's personnel file from Independence prior to hiring him.
