Looks like the plot thickens...He also named another party in the lawsuit, other than the property owner. Seems the second party let another rider ride his bike that day, and that is who ran into this Shane Simon. So....he's sueing the owner of the bike also (not the rider as he was apparently a minor), for leaving an untrained rider use his bike. Here's the court filing....(Hey, it's public record so nobody needs to get upset about this posting)......

I hope the waiver is enough to stand up in court...if this gets protracted it could get ugly. IMO the bottom line is..."you pays ya money, you takes ya chances". Unfortunate, unlucky, bad kharma...who knows, but nothing to get the law involved with. Lawyers, politicians, preachers...run away!

Considering all the tracks being shut down, Im going to assume the waivers dont hold up all that well.

The 'untrained' rider should sue him for letting him ride his bike. I know of a 'mechanic' that was working on a pro's bike, rode it to make sure his work was good, got hurt, and sued the pro who owned the bike!

I was there riding that day.........Saw the whole thing..... for sure a real bad deal.....Not the track owners fault though in my eyes.......wrong place at the wrong time for that guy.....

Anyone who sues a track owner should be hung from a tree by their balls and beaten by a plank with a rusty nail in the end.

I'm not familiar with the US legal system, but in Australia waivers will not apply if the supplier (track owner) is grossly negligent in their actions. i guess it will be up to a judge as to whether or not the track dividers were up to the task

Yeah, the over litigious behaviour is a bit of a joke...

But, i've read the thread on thumpertalk and it sounds like there is more to it... But at any rate, have some responsibility... It wasn't the track owners, and a bale of fuckin hay isn't gonna stop a collision... Look at SX... there are tuffblocks everywhere, doesn't stop shit!

Sad though, hope the track doesn't shut down for any of you guys near by!!!
