I think they hand out the lowest number available, to the highest ranking rider (of riders who scored the minimum the previous year) without a "career" number. Alternatively if you have scored the required points for a career number, you can request one that is not already used, although this can only happen with numbers of riders who have abandoned their non-career number, and cannot be taken from a rider who is returning, whether he scored the minimum points or not in the previous season. This leaves rookies as last to receive or choose a number.
the career numbers are set for at least one year after the last year you score the minimum points. non career numbers are open the following year, but you rarely see them change unless they are abandoned and then requested by a different return rider who did not score the requirement for a career number. In the end, the AMA is going to change your number as little as possible if you are competing year to year and don't make any requests.

I imagine if Tomac took 9 instead of 3 - they would still let Brown run 3 even tho he only scored 10 points last year.
And then we would be having a different conversation right now. This is the numbering system's problem, not Ivan's.
