Can you leave the country with probation? As in Toronto SX?

Well.....that's good news. I never thought he was going to get any jail time and 75hrs of CS is nothing. I think James is probably a really good kid who just did something stupid. Hopefully now he can focus 100% on the task at hand and be ready for A1. I kinda can't wait to see how well he fits that JGR Yamaha. But I am even more excited that he says he's doing the nationals.......at least I hope so.

If he was an average guy crossing the boarder, he's not always going to get in.

I think Jame's community service should be a "ride day" at his house for all Vital/MX message board posters!Evil

I think crossing the border will be a problem only if his offence results in a criminal record. Am I right in assuming that a misdemeanor doesn't result in a criminal record and a felony does?

One is obviously more serious then the other but they are both criminal offences that go on your record.

I was thinking he could maybe spend 75 hours helping OC & GuyB Mod this forum and post up some PR's & other content. Smile

From the article. "...adjudication of guilt was withheld because he is a first-time offender."

In California I think it's less of an issue of how rich people are treated, versus an issue of jail overcrowding. Because of overcrowding the state recently did what they call a "realignment" where some state prisoners were moved back to county jails, which are also overcrowded. They've been letting many prisoners out much earlier.

They're actually not expecting Conrad Murray to spend a lot of time behind bars for the same reason.

Average guy with even a misdemeanor would have a problem getting into Canada, James probably not.

Such as?
You seem to know, please tell us.
Something you can show in a write up or newspaper.
And don't say ride days, that's part of his job promoting Redbull.

Anyone with a conviction in the United States that is treated as a felony or indictable offense in Canada is excludable from Canada, but even if the offense is not a felony or indictable offense in Canada, Customs and Immigration Officers have ultimate authority to permit and deny entry to Canada.²

Almost all convictions (including DUI, DWI, reckless driving, negligent driving, misdemeanor drug possession, all felonies, domestic violence (assault IV), shoplifting, theft, etc) can make a person inadmissible to Canada, regardless of when they occurred. For this reason, it is not recommended that persons with past convictions attempt to enter Canada without first obtaining necessary documents. It is always the final decision of officers at ports of entry to decide whether a person should be allowed into Canada.³

Said all along that's what it'd plea down to.
The community service can be easily done depending on its requirements. Must it be local? Can national community work be applied? Visit some schools. Makes couple PSA's with JGR/Toyota. Few appearances at schools and say "stay in skool"...the community service could be easily done

From what I know, there was no real case here and it was pretty weak. A trial would have been costly on both sides. This is likely why he's getting "withhold of adjudication"...after all is said and done, it never happened...he was never "convicted" of anything.

And we also freed the majority of Europe from speaking German about 70 years ago.
