According to our Dutch news site, Herlings is not allowed to ride the AMA Nationals this summer.
The reasons they give are injury possibilities (as he isn't fully recovered by then) and the fact that they already have Musquin and Webb for USA.
Seems like he really wanted it, last week he was in a show PepTalk at ZiggoSports and he stated there that he would fly to Austria this week to talk about it with Beier

I think the real question is whether or not he will be willing to ride around behind TC if that is what is needed for KTM to win the MXGP championship.
It's a loss for KTM as I personally think that Herlings would do a f@ck load of winning with a possible Championship at the end.
Herlings racing the Nationals would likely create far more more interest worldwide than anything else KTM achieves in 2019, championships included.
Isn't that the whole point of a manufacturer going racing ?
AND......let me stir the pot here, the "whose better" between the US and Europe argument would have been settled.

Option A: Ride the World Championship Series, a series you’ve already won, and have zero chance to win the championship. This is currently the premier MX series in the world.
Option B: Ride the US Championship Series, a series you’ve only competed in at one race, and have a great chance to win the championship. This is currently the second best MX series in the world. And, given the circumstances, this will be the only opportunity of your career to go get this championship.
Seems pretty obvious to me honestly.
If only Cairoli gets injured, they won't be able to take any wins in MXGP and will have to look at Honda, Kawasaki or whatever Japanese brand to take the wins away. (don't see Coldenhoff or Anstie or the Husky boys winning...).
So I completely understand their decision. And besides that, it's Herlings so you never know what's gonna happen. He might just show up at Valkenswaard.....
