That clearly not true. Hospitals have negotiated rates with insurance companies. As a part of this, they have to ask the necessary questions up front. They also have to provide different info depending on the situation IE if you’re hurt at work and they have to assess if you can go back immediately or not

Hospitals don't determine liability.

They do ask questions (if they are a good facility) to determine if there are any factors that may be needed to be known for care. If you have insurance, they will always bill that insurance unless it is occupational or they have alternate billing instructions such as your auto insurance for a claim covered under your medical payments portion of that policy.

Ultimately the patient is the liable entity either way, but the medical provider will bill who they are instructed to. They don't determine whether someone else is liable.

Yes forgot they do ask if its work related.
You may have missed where I referred to "occupational". That means work related.....

Ok what does everyone feel about Sarah Whitmore suing for her injuries ? She was a professional motocross racer who should have refused to ride the Chinese Zero X bike that broke into pieces while she was riding it in a stunt show. Does she not have the responsibility to account for her own safety ? It is terrible she got hurt but she of all people would know what she was riding was a piece of junk but did it anyway and paid the price. No one wants to be responsible for their own safety, look at these parents who put their kid on a bike at a very young age and then sue when the kid gets hurt. A lot of the reason tracks close and the sport is shrinking is because of the people in the sport.

Absolutely not. As a professional, she needs to know the risks and be 100% responsible for making sure she' on equipment that is safe to so what she does.

Durhamtown Offroad Park announced today they are closed effectively immediately. Very sad for our sport.

So two things from the article.

1. They claimed the culvert was shielded with tires but the kids GoPro showed it was not. The owner testified it was but proved wrong in court, not so good.

2. Durhamtown couldn’t produce the kids father’s signed waiver form? What’s up with that?
They never found RC16/Rich Cains signed waiver either
