3-0, The Allen Family!!...we won again for the third and final time against the Schoolcraft Township Board!! The track stays and justice prevails!! A huge thanks and shout out goes to Ross D. Plont, attorney out of Grand Rapids, Michigan, for his tenacity, passion and professionalism with the handling of our case. He is a class act and a great friend.
Unfortunately, we continue to be harassed by several people, a select few of whom have attempted to show THEY have more influence and power in the area because they have lived here longer than us. Individuals like Ron Avis, George Goodsell, Judy Jogerst...calling the police and overtly stopping on the road in front of our house to videotape my family, our friends and our property...unbelievable and completely disrespectful...note: I would advise you not to publish or broadcast those videos to the public via any medium.
I will close now with a reiteration to ALL citizens of Schoolcraft Township, and/or any Township for that matter, to refuse to allow your local government to threaten you as they often times have personal interest and no legal standing to do so...we are a perfect example for others to follow.
I encourage all that care to share this via any and all internet forums so that others know they do not have to bow down.

Our newest addition to the family as of 2 weeks ago...absolutely no need for the CAT tracked skid steer anymore. This thing is a beaut and runs like a dream.

I'm pumped for you and your family. That's a big win for you guys and a step in the right direction for anyone who owns land and wants to use it as they see fit.
Sorry you had to go through this, and even before you pushed some dirt together and even rode a bike around.
Too bad. Crummy neighbors can really ruin a good life.
Also - the country side is not exactly quiet. Ever lived near an operational farm? definately not quiet. to the point where the Right to Farm act covers them. Day or night, you can do whatever you want, in the pursuit of farming.
If you want peace and quiet, you have to buy enough land around you to guarantee that peace and quiet. Besides that, there is no guarantees.
Michigan country people are all mad they can't afford to go to Florida for the winters anymore :0)
Next time I'm up a Gun Lake I gotta swing by this track, is it open to people born in Michigan raised in Florida? :0)

However the police are able to measure the noise out to public areas and other private properties, if it does not exceed a certain decibel then they are good. There is a guy in my area that filed a noise complaint on me for my dual sport bike, a KLR650 no less.
One morning I saw a township officer out with his device and looking my way when I drove out. I turned around and spoke to him and found he was measuring the noise and I was no where near a violation. End of story.
I would bet, as loud as 2 strokes are, the noise outside is property is below the threshold.
We are still fighting similar issues here in Oklahoma. We had a neighbor that literally tried everything to shut us down, When they could no longer find anything to legally shut us down they offered to buy us out of our lease. We accepted their mid 5 figure offer and have started to move about 5 miles straight north onto 3 X as much land. Only problem now is we ended up actually having to sue them as they have yet to pay and now claim we tried to defraud them into buying out our lease (It was their idea / offer, not ours.)
When a guy buys property next to you, he could have wild raging parties every night, start an industrial farm, or build a mx track. In the end, the two that are most offensive can be remedied with kindness. (good luck stopping that farm.) This guy tried to do it the right way and his "neighbors" were having non of it...before the track was even built. It then goes thru the court system wasting valuable public resources. Not how I wan my tax dollars spent.
Finally, I guess the whole, "Its a free country" is lost with people who want to use their property the way they want to use their property. Maybe your wife's cooking has an offensive smell, maybe your dogs bark too much, I don't know what it is but I'm sure you're far from a perfect neighbor as well. It's pretty basic. You can't tell your neighbor what to do with his property anymore than he can tell you what to do with yours. (Now if he's riding at midnight then, yeah, you have a right to get pissed.)
Stop fighting fire with fire. My grandpa always said you attract more bees with honey than with vinegar. Unfortunately, most people are trying to attract bees with bad attitudes and closed minds. It just doesn't work like that my man.
Who knows, that guy with the mx track might have a water truck and save your house from burning down one day. Even if you're not nice to him. That's just how moto people are...especially in the Midwest.
I live in very flat dairy farming country and have a small natural terrain track on the south end of our 100+ acres. Farming is in fact noisy but in the flat terrain the sound from the track goes out 360 degrees. I just try to be respectful and not ride in the early mornings or the evening. Just because I CAN ride whenever I want doesn't mean I want to impact people if I can help it.
Being considerate can't hurt but some people will never be happy if they hear a dirt bike...............
Show me a non corrupt local government and i'll show you a virging monster energy girl.
