It's bad enough that we have the Rich Cain scumbags suing tracks, but now we have this???

GENE CRUCEAN, an individual,

V.

GLEN HELEN RACING, INC., a California Corporation

"Plaintiff is informed and believes, and based thereon alleges, that at all times mentioned herein, Defendant GLEN HELEN RACING, INC. (hereinafter "GLEN HELEN") is a California Corporation located in and operating in San Bernardino, California and is thus subject to the jurisdiction of this Court."

"GLEN HELEN did not follow its own procedures, policies, and/or rules"

CAUSES OF ACTION
NEGLIGENCE

"As a direct and proximate result of Defendants' aforementioned negligent conduct,
Plaintiff suffered and will continue to suffer, damages in an amount to be proven and determined
at the time of trial."

So fucked up.

Why are all the western country's being fucked up by banksters/politions/lawyers?

I've been thinking to move to the US. But things like this makes me mad. While in europe we are suffering from socialism (please don't let this cancer fuck up the US aswel).

Kongols, this doesn't deserve to be buried in the 6th page of some other thread. It deserves it own discussion.

Like CamP said, track suing scum......

I think Glen Helen is only one component there. If I'm not mistaken, that's one-third of the parties being sued.

People and corporations get sued all of the time, it doesn't mean they win.

The simple fact is that neither the individual or his lawyer are motocross people. A closed track or raised riding costs will not effect their lives at all. On a different note it will probably cost them their case against VF since no motocross rider is going to testify against a track or a race team. So all of a suddent their will be no witnesses. The lawyer thought he was smart going after the money but this will most likely burn him. I cant see Michael Sleeter, Austin Squires and other witnesses testifying in court against a track.

Can someone go over what the dust-up was all about? The parties involved? Any video?

Apologies in advance if this has already been covered.

Just like no motocrosser would come in and announce what the vision of "all" motocrossers is, try to influence the crowd here, and list off some of the most likely potential witnesses.

Oh, wait...

For the record, I'm against the shotgun approach to lawsuits.

Per MXA;

"In what should have been Michael Leib’s happiest day, the former 250 Grand Prix and Factory Husqvarna rider had his day spoiled by an ugly incident on the starting line between racer Vince Friese and a member of the Leib family.

Before the results were posted and the $4500 in L.A. Sleeve purse money paid to the top ten, the San Bernardino Sheriff’s Department rolled three squad cars into Glen Helen...looking for Vince Friese. Without any assumptions of guilt, the story goes that Friese was involved in an altercation with a spectator (who was related through marriage to the Leib family) on the starting line. In the course of the altercation, the spectator was knocked out by Friese and ended up in the hospital.

Because the victim was in the hospital, the Sheriffs on the scene chose not to detain Vince Friese at the track, but instead were going to interview the person who was sent to the hospital...and then decide whether to file criminal charges.

Because Friese laid hands on another person while on the starting line, and was by his own admission involved in a fight, he was disqualified by the track management...who were already upset with Vince for failing to report to sign-up for a reprimand about an unrelated incident in the first moto.

Friese’s disqualification cost him $1000 in purse money. The track has a "no fighting rule" that DQ’s riders involved in fights (of course, spectators who fight are ejected from the park). Most eyewitness statements, which the police took from other riders who were on the starting line at the time, said that the verbal dispute between the two combatants was aggravated by Friese’s action...not by the person who was sent to the hospital...although he was not without some responsibility for things getting out of hand.

Eyewitness Mike Sleeter said, “From what I saw on the starting line, Friese was third gate pick behind me and Michael Lieb and he lined up next to Michael Leib. Michael Leib moved gate picks and Friese followed him. Some words were exchanged and I could tell there was some obvious tension between the two riders. Somebody from Leib's posse said something to Friese and then Friese threw a head butt with his visor and followed it up with three right hooks. I could not believe this. From what I have heard and seen Friese doesn't have the best track record, so my suggestion is let the speed and finish do the talking.”

The Sheriff’s Department will iron out the details and determine whether to charge Vince Friese. This is a serious offense (remember Jason Lawrence spent time in a SoCal prison for assaulting someone...although no one had an ear bitten off in this encounter). Most in-the-know motocross fans will not be surprised that Vince Friese was involved. Cutting the course and getting in fight on the starting line are not the best way to represent your sponsors."

Vince Friese would have finished second overall, but he was stripped of his finish and his money...moving the riders behind him up one place at the pay window.

For Michael Leib it is an important win, in part because he earned it with hard riding and also because he needs a victory to prove to the naysayers that he can win."

I think I can safely say that most, not all, but most motocross riders believe that you should not sh*t where you play.

Considering witness statements were in MXA's write up and pictures were on this forum it doesnt take a rocket scientist to figure out who potential witnesses are.

The simple fact is the lawyer is looking for cash and the track has liability insurance.

No but by suing the track you are shitting where you play. Still don't get how someone in the Leib family would sue a local track. This sport has a hard enough time keeping tracks around with out these lawsuits.

9/19/2012 4:16 AM

So the eyewitness didn't say anything about a helmet chinbar grab that I'm pretty sure we all saw in some video?

Just shows that there is more than one side to any story, eyewitness or not.

So where is the video showing all this?

"So you're telling me there's a chance!!"

9/19/2012 5:20 AM

Do we really believe witnesses would or should commit perjury to protect a motocross track? That's bullshit no matter how much you love the sport, and no matter how many tracks have been closed. Depositions will be taken, witnesses should tell the truth, and the case will go where it goes.

Entitlement

Bad decision making

Gang mentality

Lies

Lack of committment and consistent follow through in regards to the rules

Dude, get a clue. It doesn't matter if they win or not, the point is it will cost Glen Helen money (lots of it) just to defend themselves. What this means for us as riders is the possibility of another track closure because of liability insurance that is too expensive to pay for or higher practice, race and gate fees. Either way, we lose because of jackasses like this guy.

I got "peoples" here that know I'm down.

9/19/2012 6:37 AM

Wait a sec. Was this the incident where some nob with a backpack put a rock under Friese's tire on the starting line?

Was that guy Gene Crucean? Unfortunately, I can't find the video anywhere.

Humm, I don't know what was said but if the helmet grab came before the right hooks, how can you blame Friese? For the record, I am not a Friese fan at all and I have criticize him before for his antics on the track.

The self appointed starting area bouncer got bounced. Like I said before, I have no sympathy for people that start fights, then get their asses kicked.

This is a good example of why the AMA doesn't let a rider's entire entourage into the staring area. You never know when an entourage will turn into a goon squad.

Perjury and a foggy memory or failure to recall all together are completely different things. There's lying and then there's just not remembering.

Well shit.....I am going to get flamed for saying this..........

I dig the Leib's......they seem like some really good people , but their retaliative that grabbed VF's helmet was in the wrong. I'm sorry , but if someone grabbed my face mask like that and started jerking it around......I would have thrown some right hooks as well. This has nothing to do with the Leib's at all......so I want to make that clear.

Also......I think VF was in the wrong for following Mike to every starting position. He should not of been allowed to do so , just to prevent an altercation.

Both Gene and VF are in the wrong here......but from "my point of view ".......Gene started it.

BTW......why the hell would " Gene " sue the friggin' track? That's bullshit right there! Go after VF , that's his decision , but leave Glen Helen out of it.

So, Gene got beat up by VF and sued Glen Helen, among a few other people? Is that what I am getting here?

9/19/2012 8:29 AM

The question is did he grab Friese`s helmet after Friese headbutted him with his helmet or before that?

The pessimist says it can`t get any worse, the optimist says it can.

Why is it wrong to follow your competition to flank their starting position? It's called racing strategy. It's the same strategy that Pro Circuit used at Glen Helen in '06 when they had team riders flank Allesi on both sides of his starting gate in an attempt to stifle his start and allow RV clear sailing for the Championship. When VF does it, he's an asshole. When PC does it, they are geniuses.

9/19/2012 8:44 AM

Wow, never thought I'd be defending Vince Friese...

But you never grab someone's helmet and jerk, not only does it fucking hurt but you can seriously injure someone. A chickenshit move. If you're gonna throw down wait for the guy to take his helmet off. That's like kicking someone in the nuts in a fight, and "Gene" deserved to get his ass kicked.

He also deserves to get his ass kicked by everyone who races at GH. He starts shit, gets throttled and sues the track because he can't sue Vince (most likely because "Gene" made the first move)? C'mon... be man, admit you fucked up and move on. Don't hurt what is a big part of the SoCal moto scene.
