So I was wondering how Alpinestars, EVS and Atlas are able to make neck braces when Leatt holds the patent.

I deal with patents quite a bit, there are a lot of ways to get around patents. I haven't looked at Leatt's patent, but depending on the claims the USPTO gave them at the end of the patent process, is what they are protected from someone using. Has Leatt tried to sue the other neck protectors manufacturers? Also the designs are really different. A patent is only as strong as it is in a trial, and lawsuits are like warfare it's not always who's right, it's most likely who has the most money to get the best attorneys.

And about how much a defending manufacturer can prove differences in the designs.

Aren't they also tied to country or origin or where the patents are lodged?

The Atlas nracr with the split across the sternum and spine makes it different enough to keep it from impinging on the Leatt design.

The way to look at it is this way. Honda did not invent thr brake hose but was able to patent the routing of the hose. This forced Yamaha Kawasaki and Suzuki to route the hose under the fork leg or pay Honda to route the hose the way all bikes are now. Once Honda's patent expired every manufacturer switched to the current routing.
